The Social Security Benefits Up-rating and Miscellaneous Increases Regulations 1999

The Secretary of State for Social Security, in exercise of the powers conferred by sections 122(1), 171D, 171G(2) and 175(1) to (4) of, and paragraphs 2(3) of Schedule 7 to, the Social Security Contributions and Benefits Act 1992(1), and of all other powers enabling him in that behalf, after agreement by the Industrial Injuries Advisory Council in relation to regulation 2, and the Social Security Advisory Committee in relation to regulation 3 of these Regulations that proposals to make those regulations should not be referred to them(2), hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Social Security Benefits Up-rating and Miscellaneous Increases Regulations 1999 and shall come into force on 12th April 1999.

Amendment of the Social Security (General Benefit) Regulations 1982

2.  In regulation 16 of the Social Security (General Benefit) Regulations 1982(3) (earnings level for the purpose of unemployability supplement) for the sum of “£2,496” there shall be substituted the sum of “£3,016”.

Amendment of the Social Security (Incapacity for Work) (General) Regulations 1995

3.  In regulation 17(2)(a) of the Social Security (Incapacity for Work) (General) Regulations 1995(4) (weekly limit in relation to exempt work) for the sum of “£48.00” there shall be substituted the sum of “£58.00”.

Revocation

4.  Regulation 4 of the Social Security Benefits Up-rating Regulations 1998(5) and the Social Security (Incapacity for Work) (General) Amendment Regulations 1998(6) are hereby revoked.

Explanatory Note

(This note is not part of the Regulations)

This instrument contains provisions to increase the amounts in respect of the earnings limit as a consequence of an order under section 150 of the Social Security Administration Act 1992 (up-rating of benefits). In addition, the amount of the increase provided for reflects the welfare to work initiative aimed at encouraging sick and disabled people to work if they can.

Regulation 2 raises from £2,496 to £3,016 a year the earnings limit which applies to unemployability supplement.

Regulation 3 raises from £48.00 to £58.00 a week the earnings limit which applies to incapacity for work.

Regulation 4 contains a revocation consequential upon the coming into force of these Regulations.

These Regulations do not impose any costs on business.
