The River Tay Salmon Fishery District (Baits and Lures) Regulations 1999

Coming into force

The Secretary of State, on application to him by the River Tay District Salmon Fishery Board, having consulted and directed that notice be given in accordance with paragraphs 3 and 4 of Schedule 1 to the Salmon Act 19861, as applied by section 8(5) of that Act, and having considered objections made to the application, in exercise of the powers conferred on him by section 8 of that Act and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation and commencement1

These Regulations may be cited as the River Tay Salmon Fishery District (Baits and Lures) Regulations 1999 and shall come into force on 1st March 1999.

Specification of baits and lures2

Natural prawns and shrimps (whether fresh or preserved, dyed or natural colour) and any part thereof are hereby specified as baits and lures for the purposes of the definition of “rod and line” and section 24(1) of the Salmon and Freshwater Fisheries (Protection) (Scotland) Act 19512.

Areas of application3

These regulations shall apply to the River Tay Salmon Fishery District.

Revocation4

The River Tay Salmon Fishery District (Baits and Lures) Regulations 19923 are hereby revoked.

These Regulations specify natural prawns and shrimps (whether fresh or preserved, dyed or natural colour) and any part of them, as baits and lures for the purpose of the definition of “rod and line” in section 24(1) of the Salmon and Freshwater Fisheries (Protection) (Scotland) Act 1951 (regulation 2).

The use of prawns and shrimps is thereby prohibited in the River Tay Salmon Fishery District (regulation 3).

Regulation 4 revokes the River Tay Salmon Fishery District (Baits and Lures) Regulations 1992.
