The Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred by sections 54, 61, 63 and 66 of the Road Traffic Act 1988(1) and of all other powers enabling him in that behalf, and after consultation with representative organisations in accordance with section 195(2) of that Act, hereby makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Motor Vehicles (Approval) (Amendment) (No. 2) Regulations 1999 and shall come into force on 31st December 1999.

Preliminary

2.  The Motor Vehicles (Approval) Regulations 1996(2) shall be further amended in accordance with the following provisions of these Regulations.

Amendment of regulation 3 (application of Part II)

3.  In regulation 3(1)(b) after the words “paragraph 1, 1A,” there shall be inserted “1B,”.

Amendment of regulation 5 (application of Part III)

4.  In regulation 5(1)(c) after the words “paragraph 1, 1A,” there shall be inserted “1B,”.

Amendment of regulation 12 (form of certificate)

5.  In regulation 12(2) after sub-paragraph (b) there shall be inserted the following sub-paragraph—

(bb)the letter “S” if the certificate is being issued on the basis that the vehicle meets the requirements of paragraph 1B of Schedule 1 to these Regulations;.

Amendment of Schedule 1 (Application of Regulations—supplemental provisions)

6.—(1) Schedule 1 shall be amended as follows.

(2) In paragraph 1—

(a)paragraph (1)(b) shall be omitted; and

(b)in sub-paragraph (6) the words “; and “the five year period”” to the end of the paragraph shall be omitted.

(3) After paragraph 1A there shall be inserted—

Rebuilt vehicles

1B.  A vehicle satisfies the requirements of this paragraph if—

(a)it is a vehicle to which the Secretary of State is required by regulation 8 to assign a vehicle identification number; and

(b)it is not a vehicle which satisfies the requirements of paragraph 1A, 2, 3 or 4.

Explanatory Note

(This note is not part of the Regulations)

These Regulations further amend the Motor Vehicles (Approval) Regulations 1996. Schedule 1 is amended by the omission of paragraph 1(1)(b), thus removing the limitation on the total number of vehicles which can meet the requirements of paragraph 1 within a period of 5 calendar years, and by the insertion of paragraph 1B which defines a new vehicle class consisting of vehicles to which a new vehicle identification number is assigned by the Secretary of State under regulation 8. Consequential amendments are made to other provisions of the 1996 Regulations.
