The Secretary of State for Social Security, in exercise of the powers conferred upon him by sections 79(3) and (4) and 87(2) and (3) of the Social Security Act 1998M1 and of all other powers enabling him in that behalf, after consultation with the Council on Tribunals in accordance with section 8 of the Tribunals and Inquiries Act 1992M2, hereby makes the following Order:

1.—(1) This Order may be cited as the Social Security Act 1998 (Commencement No. 12 and Consequential and Transitional Provisions) Order 1999.

(2) In this Order, unless the context otherwise requires–

(a)“the Act" means the Social Security Act 1998;

(b)“the 1997 Regulations" means the Social Security (Recovery of Benefits) (Appeals) Regulations 1997 M3;

(c)“the Adjudication Regulations" means the Social Security (Adjudication) Regulations 1995 M4;

(d)“legally qualified panel member" has the meaning it bears in regulation 1(3) of the Regulations;

(e)“the No. 8 Order" means the Social Security Act 1998 (Commencement No. 8, and Savings and Consequential and Transitional Provisions) Order 1999 M5;

(f)“the No. 9 Order" means the Social Security Act 1998 (Commencement No. 9, and Savings and Consequential and Transitional Provisions) Order 1999 M6;

(g)“the No. 11 Order" means the Social Security Act 1998 (Commencement No. 11, and Savings and Consequential and Transitional Provisions) Order 1999 M7;

(h)“the Regulations" means the Social Security and Child Support (Decisions and Appeals) Regulations 1999 M8; and

(i)“relevant benefit" means income support, child’s special allowance under section 56 of the Contributions and Benefits Act or, as the case may be, a social fund payment mentioned in section 138(1)(a) or (2) of that Act,

and references to sections and Schedules are references to sections of, and Schedules to, the Act.

Appointed dayE+W+S

2.—(1) Subject to paragraph (2) below, 29th November 1999 is the day appointed for the coming into force of the–

(a)the provisions specified in Schedule 1 to this Order; and

(b)sections 1 and 4 to 7 in relation to–

(i)statutory sick pay under Part XI of the Contributions and Benefits Act; and

(ii)statutory maternity pay under Part XII of that Act,

in so far as those provisions are not already in force.

(2) Paragraph (1)(a) above shall not apply in relation to–

(a)housing benefit;

(b)council tax benefit; nor

(c)decisions to which article 4(6) of the Social Security Contributions (Transfer of Functions, etc.) Act 1999 (Commencement No. 1 and Transitional Provisions) Order 1999 M9 applies.

(3) 31st March 2000 is the day appointed for the coming into force of paragraph 10 of Schedule 1 (appeal tribunals: supplementary provisions) and sections 5(3) and 7(7) in so far as they relate to it.

Consequential amendmentsE+W+S

3.—(1) The amendments and revocations effected by this Order–

(a)shall take effect as from 29th November 1999; and

(b)shall not have effect in relation to–

(i)working families’ tax credit;

(ii)disabled person’s tax credit;

(iii)decisions to which article 4(6) of the Social Security Contributions (Transfer of Functions, etc.) Act 1999 (Commencement No. 1 and Transitional Provisions) Order 1999 applies.

(2) The Social Security Benefit (Dependency) Regulations 1977 M10 shall be amended in accordance with Schedule 2 to this Order.

(3) The Social Security (General Benefit) Regulations 1982 M11 shall be amended in accordance with Schedule 3 to this Order.

(4) The Social Fund Maternity and Funeral Expenses (General) Regulations 1987 M12 shall be amended in accordance with Schedule 4 to this Order.

(5) The Income Support (General) Regulations 1987 M13 shall be amended in accordance with Schedule 5 to this Order.

(6) The Social Security (Claims and Payments) Regulations 1987 M14 shall be amended in accordance with Schedule 6 to this Order.

(11) The Community Charges (Deductions from Income Support) (No. 2) Regulations 1990 M18 shall be amended in accordance with Schedule 11 to this Order.

(12) The Fines (Deductions from Income Support) Regulations 1992 M19 shall be amended in accordance with Schedule 12 to this Order.

(13) The Council Tax (Deductions from Income Support) Regulations 1993 M20 shall be amended in accordance with Schedule 13 to this Order.

(14) The Employment Protection (Recoupment of Jobseeker’s Allowance and Income Support) Regulations 1996 M21 shall be amended in accordance with Schedule 14 to this Order.

(15) The Social Security (Back to Work Bonus) (No. 2) Regulations 1996 M22 shall be amended in accordance with Schedule 15 to this Order.

(16) The Social Security Benefit (Computation of Earnings) Regulations 1996 M23 shall be amended in accordance with Schedule 16 to this Order.

(17) The Social Security (Recovery of Benefits) Regulations 1997 M24 shall be amended in accordance with Schedule 17 to this Order.

(18) The Social Fund Winter Fuel Payment Regulations 1998 M25 shall be amended in accordance with Schedule 18 to this Order.

(19) The Social Security and Child Support (Decisions and Appeals) Regulations 1999 shall be amended in accordance with Schedule 19 to this Order.

(20) The No. 8 Order, the No. 9 Order and the No. 11 Order shall be amended in accordance with Schedule 20 to this Order.

SCHEDULE 2E+W+S AMENDMENT OF THE SOCIAL SECURITY BENEFIT (DEPENDENCY) REGULATIONS 1977

1.  In regulation 1(2) M52 (interpretation), for the definition of “the determining authority" there shall be substituted the following definition–E+W+S

“determining authority" means, as the case may require, the Secretary of State, an appeal tribunal constituted under Chapter I of Part I of the Social Security Act 1998 (“an appeal tribunal") or a Commissioner within the meaning of section 39(1) of that Act;.

3.  For paragraph (1) of regulation 41 M57 (capital treated as income) there shall be substituted the following paragraph–E+W+S

(1) Capital which is payable by instalments which are outstanding on–

(a)the first day in respect of which income support is payable or the date of the determination of the claim, whichever is earlier; or

(b)in the case of a supersession, the date of that supersession,

shall be treated as income if the aggregate of the instalments outstanding and the amount of the claimant’s capital otherwise calculated in accordance with Chapter VI of this Part exceeds £8,000 or, in a case where regulation 45(b) M58 applies, £16,000..

4.  In regulation 42 (notional income)–E+W+S

5.  For paragraph (1) of regulation 44 M61 (modifications in respect of children and young persons) there shall be substituted the following paragraph–E+W+S

(a)the first day in respect of which income support is payable or at the date of the determination of the claim, whichever is the earlier; or

(b)in the case of a supersession, the date of that supersession,

shall be treated as income if the aggregate of the instalments outstanding and the amount of that child’s or young person’s other capital calculated in accordance with Chapter VI of this Part in like manner as for the claimant would exceed £3,000..

9.  In Schedule 3 M63 (housing costs)–E+W+S

(i)for sub-paragraph (6) there shall be substituted the following sub-paragraph–

(6) Where sub-paragraph (4) does not apply and the claimant (or other member of the family) was able to meet the financial commitments for the dwelling occupied as the home when these were entered into, no restriction shall be made under this paragraph during the 26 weeks immediately following the date on which–

(a)the claimant became entitled to income support where the claimant’s housing costs fell within one of the cases in sub-paragraph (1) on that date; or

(b)a decision took effect which was made under section 10 (decisions superseding earlier decisions) of the Social Security Act 1998 on the ground that the claimant’s housing costs fell within one of the cases in sub-paragraph (1),

nor during the next 26 weeks if and so long as the claimant uses his best endeavours to obtain cheaper accommodation.; and

(ii)in sub-paragraph (8)(b), the words “on appeal or review" shall be omitted;

(b)in paragraph 14–

(i)in sub-paragraph (1)(a)(i), for the words “held, on appeal or review," there shall be substituted the word “ determined ”;

(ii)in sub-paragraph (1)(b), for the words “held on appeal or review" there shall be substituted the word “ determined ”; and

(iii)in sub-paragraph (2)(a), the words “on review" shall be omitted; and

(c)in paragraph 18(2) and (7)(a), for the words “adjudication officer" there shall be substituted the words “ Secretary of State ”.

SCHEDULE 6E+W+S AMENDMENT OF THE SOCIAL SECURITY (CLAIMS AND PAYMENTS) REGULATIONS 1987

Modifications etc. (not altering text)

1.  Subject to paragraphs 2 and 4 to 6, 10, 12 and 17 for the words “adjudicating authority" in each place in which they occur there shall be substituted the words “ Secretary of State ”.E+W+S

2.  In regulation 2(1) (interpretation)–E+W+S

(a)the definition of “adjudicating authority" shall be omitted; and

(b)in paragraph (c) of the definition of “claim for benefit"M65 for the words “the review of an award or"–

(i)in the first place in which they occur there shall be substituted the words “ a revision under section 9 of the Social Security Act 1998 or a supersession under section 10 of that Act of ”; and

(ii)in the second place in which they occur there shall be substituted the words “ a revision or a supersession of ”.

3.  In regulation 3 M66 (claims not required for entitlement to benefit in certain cases), for paragraph (g) there shall be substituted the following paragraph–E+W+S

(g)in the case of a jobseeker’s allowance where–

(i)payment of benefit has been suspended in the circumstance prescribed in regulation 16(2) of the Social Security and Child Support (Decisions and Appeals) Regulations 1999; and

(ii)the claimant whose benefit has been suspended satisfies the conditions of entitlement (apart from the requirement to claim) to that benefit immediately before the suspension ends;.

4.  In regulation 13 M67 (advance claims and awards)–E+W+S

(a)for a couple where–

(i)a summary warrant or decree is made; and

(ii)that benefit is payable, in respect of both members of a couple both of whom are aged not less than 18; and

(b)in any other case, for a single claimant aged not less than 25,

and pay that sum to the levying authority towards satisfaction of any outstanding sum which is or forms part of the amount in respect of which the summary warrant or decree was granted.

(2) Subject to paragraph (3) and regulation 4, where–

(a)the Secretary of State receives an application from a levying authority in respect of a debtor who is entitled to contribution-based jobseeker’s allowance; and

(b)the amount of contribution-based jobseeker’s allowance payable before any deduction under this paragraph is equal to or more than one-third of the age-related amount applicable to the debtor under section 4(1)(a) of the Jobseekers Act,

the Secretary of State may deduct a sum from that benefit which is equal to one-third of the age-related amount applicable to the debtor under section 4(1)(a) of the Jobseekers Act and pay that sum to the levying authority towards satisfaction of any outstanding sum which is or forms part of the amount in respect of which the summary warrant or decree was granted.

(3) Where the sum that would otherwise fall to be deducted under paragraph (2) includes a fraction of a penny, the sum to be deducted shall be rounded down to the next whole penny.

(4) Before making a deduction under paragraph (1) the Secretary of State shall make any deduction which falls to be made in respect of a liability mentioned in any of the following provisions of the Social Security (Claims and Payments) Regulations 1987–

(a)regulation 34A M88 (mortgage interest);

(b)paragraph 3 M89 (housing costs) of Schedule 9;

(c)paragraph 5 M90 (rent and certain service charges for fuel) of Schedule 9; and

(d)paragraph 6 M91 (fuel costs) of Schedule 9.

(5) Subject to regulations 5 and 6, a decision of the Secretary of State under this regulation shall be final.

(b)the amount of contribution-based jobseeker’s allowance payable before any deduction under this paragraph is equal to or more than one-third of the age-related amount applicable to the debtor under section 4(1)(a) of the Jobseekers Act,

the Secretary of State may deduct a sum from that benefit which is equal to one-third of the age-related amount applicable to the debtor under section 4(1)(a) of the Jobseekers Act and pay that sum to the authority towards satisfaction of any outstanding sum which is or forms part of the amount in respect of which the liability order was made.

(3) Where the sum that would otherwise fall to be deducted under paragraph (2) includes a fraction of a penny, the sum to be deducted shall be rounded down to the next whole penny.

(4) Before making a deduction under paragraph (1) the Secretary of State shall make any deduction which falls to be made in respect of a liability mentioned in any of the following provisions of the Social Security (Claims and Payments) Regulations 1987–

(a)the Secretary of State receives an application from a court in respect of an offender who is entitled to income support or income-based jobseeker’s allowance;

(b)the amount payable by way of that benefit, after any deduction under this paragraph, is 10 pence or more; and

(c)the aggregate amount payable under one or more of the following provisions, namely, paragraphs 3(2)(a), 5(6), 6(2)(a) and 7(3)(a) and (5)(a) of Schedule 9 to the Claims and Payments Regulations, and regulation 2 of the Council Tax (Deductions from Income Support) Regulations 1993, together with the amount to be deducted under this paragraph does not exceed an amount equal to 3 times 5 per cent. of the personal allowance for a single claimant aged not less than 25 years,

the Secretary of State may deduct a sum from that benefit which is equal to 5 per cent. of the personal allowance for a single claimant aged not less than 25 and pay that sum to the court towards satisfaction of the fine or the sum required to be paid by compensation order.

(2) Subject to paragraphs (3) and (4) and regulation 7, where–

(a)the Secretary of State receives an application from a court in respect of an offender who is entitled to contribution-based jobseeker’s allowance; and

(b)the amount of contribution-based jobseeker’s allowance payable before any deduction under this paragraph is equal to or more than one-third of the age-related amount applicable to the offender under section 4(1)(a) of the Jobseekers Act,

the Secretary of State may deduct a sum from that benefit which is equal to one-third of the age-related amount applicable to the offender under section 4(1)(a) of the Jobseekers Act and pay that sum to the court towards satisfaction of the fine or the sum required to be paid by compensation order.

(3) No deduction shall be made under paragraph (2) where a deduction is being made from the offender’s contribution-based jobseeker’s allowance under the Community Charges (Deductions from Income Support) (No. 2) Regulations 1990, the Community Charges (Deductions from Income Support) (Scotland) Regulations 1989 or the Council Tax (Deductions from Income Support) Regulations 1993.

(4) Where the sum that would otherwise fall to be deducted under paragraph (2) includes a fraction of a penny, the sum to be deducted shall be rounded down to the next whole penny.

(5) The Secretary of State shall notify the offender and the court in writing of a decision to make a deduction under this regulation so far as is practicable within 14 days from the date on which he made the decision and at the same time shall notify the offender of his right of appeal..

SCHEDULE 14E+W+S AMENDMENT OF THE EMPLOYMENT PROTECTION (RECOUPMENT OF JOBSEEKER’S ALLOWANCE AND INCOME SUPPORT) REGULATIONS 1996

1.  In the heading to Part IV (determination and review of benefit recouped) the words “AND REVIEW" shall be omitted.E+W+S

2.  For paragraphs (2) and (3) of regulation 10 (provisions relating to the determination of amount paid by way of or paid as on account of benefit) there shall be substituted the following paragraphs–E+W+S

(2) Where an employee has given notice in writing to the Secretary of State under paragraph (1) above that he does not accept that an amount specified in the recoupment notice is correct, the Secretary of State shall make a decision as to the amount of jobseeker’s allowance or, as the case may be, income support paid in respect of the period to which the prescribed element is attributable or, as appropriate, in respect of so much of the protected period as falls before the date on which the employer complies with Regulation 6 above.

(2A) The Secretary of State may revise either upon application made for the purpose or on his own initiative a decision under paragraph (2) above.

(2B) The employee shall have a right of appeal to an appeal tribunal constituted under Chapter I of Part I of the 1998 Act against a decision of the Secretary of State whether as originally made under paragraph (2) or as revised under paragraph (2A) above.

(2C) The Social Security and Child Support (Decisions and Appeals) Regulations 1999 shall apply for the purposes of paragraphs (2A) and (2B) above as though a decision of the Secretary of State under paragraph (2A) above were made under section 9 of the 1998 Act and any appeal from such a decision were made under section 12 of that Act.

(2D) In this Regulation “the 1998 Act" means the Social Security Act 1998.

(3) Where the Secretary of State recovers too much money from an employer under these Regulations the Secretary of State shall pay to the employee an amount equal to the excess..

SCHEDULE 17E+W+S AMENDMENT OF THE SOCIAL SECURITY (RECOVERY OF BENEFITS) REGULATIONS 1997

For paragraph (3) of regulation 12 (transitional provisions) there shall be substituted the following paragraphs–

(3) Any appeal under section 98 of the 1992 Act made on or after 6th October 1997 which has not been determined before 29th November 1999 shall be referred to an appeal tribunal constituted in accordance with paragraph (3I) below.

(3A) Any appeal duly made before 6th October 1997 which has not been referred to a medical appeal tribunal or a social security appeal tribunal shall be referred to and determined by an appeal tribunal constituted in accordance with paragraph (3I) below.

(3B) Any appeal duly made before 6th October 1997 and referred to a medical appeal tribunal shall be determined by an appeal tribunal constituted in accordance with paragraph (3I) below which shall determine all issues.

(3C) Any appeal duly made before 6th October 1997 and referred to a social security appeal tribunal shall be determined by an appeal tribunal which shall consist of a legally qualified panel member and in making its determination, the appeal tribunal shall be bound by any decision of a medical appeal tribunal to which a question under section 98(5) of the 1992 Act was referred.

(3D) An appeal tribunal constituted in accordance with paragraph (3I) below shall completely rehear any appeal made under section 98 of the 1992 Act which stands adjourned immediately before 29th November 1999.

(3E) Where a Commissioner holds that the decision of a medical appeal tribunal or a social security appeal tribunal on an appeal made before 6th October 1997 was erroneous in law and refers the case to an appeal tribunal, that appeal tribunal shall be constituted in accordance with paragraph (3I) below and shall determine all issues in accordance with the Commissioner’s direction.

(3F) Regulation 11 of the Social Security (Recoupment) Regulations 1990 (“the 1990 Regulations") and regulation 12 of those Regulations shall have effect in relation to any appeal under section 98 of the 1992 Act made on or after 6th October 1997 with the modification that for the word “chairman" in each place in which it occurs there were substituted the words “legally qualified panel member"

(3G) Regulation 13 of the 1990 Regulations shall have effect in relation to any appeal under section 98 of the 1992 Act made on or after 6th October 1997.

(3H) Any other transitional question arising from an appeal made under section 98 of the 1992 Act in consequence of the coming into force of the Social Security and Child Support (Decisions and Appeals) Regulations 1999 (“the 1999 Regulations") shall be determined by a legally qualified panel member who may for this purpose give such directions consistent with these regulations as are necessary.

(3I) For the purposes of paragraphs (3) to (3B) and (3E) above an appeal tribunal shall be constituted under Chapter I of Part I of the Social Security Act 1998 as though the appeal were made under section 11(1)(b) of the 1997 Act.

(3J) In this regulation, “legally qualified panel member" has the meaning it bears in regulation 1(3) of the 1999 Regulations..

1.—(1) Regulation 2 of the 1997 Regulations shall, notwithstanding regulation 59 of the Regulations continue to have effect until 29th December 2000 in relation to any certificate of recoverable benefits in respect of which a right of appeal arose before 29th November 1999 subject to the modifications specified in sub-paragraph (2) below.E+W+S

(2) The modifications referred to in sub-paragraph (1) above are as if–

(a)for the word “chairman" in each place in which it occurs there were substituted the words “ legally qualified panel member ”;

(b)in paragraph (2) the words “of a medical appeal tribunal" were omitted;

(c)for paragraph (7) there were substituted the following paragraph–

(7) Notwithstanding paragraph (2), no appeal may be brought after 29th December 2000.;

(d)in paragraph (18) the words from “, notwithstanding that a condition" to the end were omitted; and

(e)after paragraph (18) there were added the following paragraph–

(19) In this regulation “legally qualified panel member" has the meaning it bears in regulation 1(3) of the Social Security and Child Support (Decisions and Appeals) Regulations 1999..

2.  An appeal duly made (but not determined) before 29th November 1999 against a certificate of recoverable benefits shall be referred to and determined by an appeal tribunal under section 12 of the Social Security (Recovery of Benefits) Act 1997 M114.E+W+S

3.—(1) Notwithstanding regulation 39 and Chapter III of Part V of the Regulations, this paragraph applies where a direction (“the direction") was given under regulation 4(1) of the 1997 Regulations.E+W+S

(2) An appeal tribunal shall hold an oral hearing of an appeal if–

(a)sub-paragraph (3) below applies; or

(b)the chairman or, in the case of an appeal tribunal which has only one member, that member, is satisfied that such a hearing is necessary to enable the tribunal to reach a decision.

(3) This sub-paragraph applies where a notification that a party to the proceedings wishes an oral hearing to be held is received by a clerk to a medical appeal tribunal before 29th November 1999 or by a clerk to an appeal tribunal (notwithstanding that it was sent to a clerk to a medical appeal tribunal) after that date within–

(a)10 days of receipt by that party of the direction; or

(b)such other period as–

(i)the clerk to, or the chairman of, the medical appeal tribunal may have directed; or

(ii)where head (i) above does not apply, a clerk to an appeal tribunal may direct.

(4) An appeal tribunal shall determine an appeal without an oral hearing where sub-paragraph (2) does not apply.

4.  An appeal tribunal shall completely rehear any appeal to a medical appeal tribunal in relation to a certificate of recoverable benefits which stands adjourned immediately before 29th November 1999.E+W+S

5.  A copy of a statement of–E+W+S

(a)the reasons for a decision of a medical appeal tribunal in relation to a certificate of recoverable benefits; and

(b)its findings on questions of fact material thereto,

shall be supplied to each party to the proceedings before that tribunal, if requested by any such party within 21 days of the date on which notification of that decision was given or sent.

6.—(1) Subject to paragraph 1(2) above and sub-paragraph (3) below–E+W+S

(a)regulation 11; and

(b)regulations 2(16) and (17) and 12 in so far as they relate to regulation 11,

of the 1997 Regulations shall, notwithstanding regulation 59 of the Regulations, continue to have effect, subject to the modifications specified in sub-paragraph (2) below, in relation to any application to set aside a decision of a medical appeal tribunal in relation to a certificate of recoverable benefits.

(2) The modifications referred to in sub-paragraph (1) above are as if in–

(a)regulation 2(16), for the words “the chairman" there were substituted the words “ the legally qualified panel member ”;

(b)regulation 11(1), for the words “the tribunal which gave the decision or by another medical appeal tribunal" there were substituted the words “ a legally qualified panel member within the meaning of regulation 1(3) of the Social Security and Child Support (Decisions and Appeals) Regulations 1999 ”;

(c)regulation 11(2)–

(i)for the words “the tribunal shall" in both places in which they occur there were substituted the words “ the legally qualified panel member shall ”; and

(ii)for the words “it is satisfied" there were substituted the words “ he is satisfied ”;

(d)regulation 11(3)(b), after the words “the office of the clerk to the tribunal which made the relevant decision" there were inserted the words “ or to a clerk to an appeal tribunal ”; and

(e)regulation 11(4)–

(i)for the words “the chairman of the tribunal" there were substituted the words “ a legally qualified panel member ”; and

(ii)for the words “a chairman" there were substituted the words “ a legally qualified panel member ”.

(3) Sub-paragraph (1) above shall not apply in any case where an application to set aside a decision of a medical appeal tribunal is made after 29th December 2000.

7.—(1) Subject to sub-paragraph (2) below, any decision of a medical appeal tribunal under section 12 of the Social Security (Recovery of Benefits) Act 1997 shall be treated as a decision of an appeal tribunal under that section.E+W+S

(2) Where sub-paragraph (1) above applies, any application for leave to appeal which is made for the purposes of section 14(10)(a) M115 shall be–

(a)made no later than three months after the date on which a copy of the statement of the reasons for the decision of the medical appeal tribunal was given or sent to the applicant; and

(b)determined by a legally qualified panel member.

SCHEDULE 22E+W+S TRANSITIONAL PROVISIONS IN RELATION TO RELEVANT BENEFITS

1.  A decision which fell to be made before 29th November 1999, but which was not made before that date–E+W+S

(a)on a claim for; or

(b)under or by virtue of Part II of the Administration Act in relation to,

a relevant benefit (other than a decision which fell to be made on review or on appeal) shall be made by the Secretary of State under paragraph (a) or, as the case may be, paragraph (c) of section 8(1).

2.—(1) Any application duly made before 29th November 1999 under Part II of the Administration Act for a review of a decision in relation to a relevant benefit which was not decided before that date shall on and after that date be treated as an application to the Secretary of State–E+W+S

(a)where the application is not in respect of a decision given on appeal and is made–

(i)within three months of the date on which the applicant was notified of the decision, or within such longer period as may be allowed under sub-paragraph (2) below; and

(ii)other than on the ground of a relevant change of circumstances,

for a revision of that decision under section 9; or

(b)in any other case, for a decision under section 10 to supersede that decision.

(2) Subject to sub-paragraphs (3) and (4) below, the period of three months specified in sub-paragraph (1)(a) above may be extended where an application for such an extension is made before 29th December 2000 by a claimant or a person acting on his behalf containing–

(a)the grounds on which an extension of time is sought; and

(b)sufficient details of the decision to enable it to be identified.

(3) An application for an extension of time shall not be granted under sub-paragraph (2) above unless the Secretary of State is satisfied that–

(a)it is reasonable to grant that application;

(b)the application for review has merit; and

(c)special circumstances are relevant to the application for an extension of time as a result of which it was not practicable for the application for review to be made within three months of the date of the adjudication officer’s decision being notified to the claimant.

(4) In deciding whether to grant an extension of time no account shall be taken of the following factors–

(a)that the claimant or any person acting for him misunderstood or was unaware of the law applicable to his case (including misunderstanding or being unaware of the period specified in sub-paragraph (1)(a) above); or

(b)that a Commissioner or a court has taken a different view of the law from that previously understood and applied by the adjudication officer.

(5) Where, by virtue of sub-paragraph (1)(b) above–

(a)a decision is made under section 10 which is advantageous to the applicant; and

(b)the same decision could have been made on a review prior to 29th November 1999,

that decision shall take effect from the date on which it would have taken effect had the decision been so made.

3.—(1) A decision (other than a decision of a social security appeal tribunal or a Commissioner) made before 29th November 1999–E+W+S

(a)on a claim for; or

(b)under or by virtue of Part II of the Administration Act in relation to,

a relevant benefit shall be treated as a decision of the Secretary of State under paragraph (a) or, as the case may be, paragraph (c) of section 8(1).

(2) Where, before 29th November 1999, any person was required to give notice to the claimant of a decision referred to in sub-paragraph (1) above, and such notice was not given before that date, the Secretary of State shall give notice to the claimant of that decision.

4.—(1) This paragraph applies where the time limit for making an appeal to a social security appeal tribunal in respect of a decision in relation to a relevant benefit made before 29th November 1999 has not expired before that date.E+W+S

(2) Where sub-paragraph (1) above applies, regulation 3 of the Adjudication Regulations as it relates to the period within which an appeal may be made, or an extension of that period, shall, notwithstanding regulation 59 of the Regulations, continue to have effect, subject to the modifications in sub-paragraph (3) below, with respect to any appeal to an appeal tribunal made on or after 29th November 1999 in relation to that decision.

(3) The modifications referred to in sub-paragraph (2) above are as if–

(a)references to a tribunal, a chairman or a person considering the application were references to a legally qualified panel member; and

(b)in paragraph (3E) M116, for the words from “6 years" to the end of the paragraph there were substituted the words “ 29th December 2000 ”.

(4) Notwithstanding regulation 3 of the Regulations, the Secretary of State may revise under section 9 a decision made before 29th November 1999 on a claim for or award of a relevant benefit (other than a decision made on appeal)–

(a)pursuant to an application for a review of a decision made within three months of the notification of that decision; or

(b)where an appeal has been duly made against that decision but not determined.

(5) Where a decision is revised pursuant to sub-paragraph (4) above the appeal shall lapse unless the decision as revised is not more advantageous to the appellant than the decision before it was revised.

5.  An appeal to a social security appeal tribunal in relation to a relevant benefit which was duly made before 29th November 1999 and which was not determined before that date shall, without prejudice to Chapter III of Part V of the Regulations, be treated as an appeal duly made to an appeal tribunal in relation to a decision of the Secretary of State under section 8.E+W+S

6.—(1) This paragraph applies where a clerk to a social security appeal tribunal has before 29th November 1999 given a direction under regulation 22(1) of the Adjudication Regulations in connection with an appeal in relation to a relevant benefit to that tribunal, and the notification mentioned in paragraph (1A) M117 of that regulation 22 has not been received by the clerk before that date.E+W+S

(2) A notification in response to such a direction given under that regulation 22(1) shall be–

(a)in writing; and

(b)made within 14 days of receipt of the direction or within such other period as the clerk to an appeal tribunal may direct.

(3) An appeal may be struck out by the clerk to an appeal tribunal where the notification referred to in sub-paragraph (2) above is not received within the period specified in that sub-paragraph.

(4) An appeal which has been struck out in accordance with sub-paragraph (3) above shall be treated for the purpose of reinstatement as if it had been struck out under regulation 46 of the Regulations.

(5) An oral hearing of the appeal shall be held where–

(a)a notification is received by the clerk to the appeal tribunal under sub-paragraph (2) above; or

(b)the chairman of the appeal tribunal or, in the case of an appeal tribunal which has only one member, that member, is satisfied that such a hearing is necessary to enable the tribunal to reach a decision.

7.  Where an appeal to a social security appeal tribunal in relation to a relevant benefit has been struck out under regulation 7 of the Adjudication Regulations, a legally qualified panel member may reinstate the appeal on an application by any party to the proceedings made not later than three months from the date of the order under paragraph (1) of that regulation if he is satisfied that–E+W+S

(a)the applicant did not receive a notice under paragraph (2) of that regulation; and

(b)the conditions in paragraph (2A) of that regulation were not satisfied,

and the appeal shall be treated as an appeal to an appeal tribunal in relation to a decision of the Secretary of State under section 8.

8.  An appeal tribunal shall completely rehear any appeal to a social security appeal tribunal in relation to a relevant benefit which stands adjourned immediately before 29th November 1999.E+W+S

9.  A copy of a statement of–E+W+S

(a)the reasons for a decision of a social security appeal tribunal in relation to a relevant benefit; and

(b)its findings on questions of fact material thereto,

shall be supplied to each party to the proceedings before that tribunal, if requested by any such party within 21 days of the date on which notification of that decision was given or sent.

10.—(1) Subject to sub-paragraph (2) below, any decision of a social security appeal tribunal in relation to a relevant benefit shall be treated as a decision of an appeal tribunal made under section 12.E+W+S

(2) Where sub-paragraph (1) above applies, any application for leave to appeal which is made for the purposes of section 14(10)(a) shall be–

(a)made no later than three months after the date on which a copy of the statement of the reasons for the decision of the social security appeal tribunal was given or sent to the applicant; and

(b)determined by a legally qualified panel member.

11.—(1) Subject to sub-paragraph (3) below, regulation 10 of the Adjudication Regulations and regulation 3 of those Regulations in so far as it relates to that regulation 10, shall, notwithstanding regulation 59 of the Regulations, continue to have effect, subject to the modifications specified in sub-paragraph (2) below, in relation to any application to set aside a decision of a social security appeal tribunal in relation to a relevant benefit.E+W+S

(2) The modifications referred to in sub-paragraph (1) above are as if in regulation 3 for the reference to a chairman and in regulation 10(1) the first reference to the adjudicating authority which gave the decision and to an authority of like status, there were substituted references to a legally qualified panel member.

(3) Paragraph (1) above shall not apply in any case where an application to set aside a decision of a social security appeal tribunal is made after 29th December 2000.

12.  Where, immediately before 29th November 1999, a payment of relevant benefit was suspended or withheld by virtue of any provision of Part V of the Social Security (Claims and Payments) Regulations 1987 M118 (suspension and extinguishment), the provisions of Chapter I of Part III of the Regulations (suspension and termination) shall apply with respect to that suspension or withholding as if it were a suspension imposed by virtue of those provisions.E+W+S

13.  For the purpose of section 10(1)(b), a decision of a Commissioner made before 29th November 1999 in relation to a relevant benefit shall be treated as a decision of a Commissioner made under section 14.E+W+S

Article 4

SCHEDULE 23E+W+S TRANSITIONAL PROVISIONS IN RELATION TO THE SOCIAL FUND

1.  An application to–E+W+S

(a)the social fund shall, from 29th November 1999, be determined by an appropriate officer;

(b)to a social fund officer for a review shall, from 29th November 1999, be treated as an application for a review by an appropriate officer.

2.  A determination of a social fund officer shall be treated as a determination of an appropriate officer from 29th November 1999.E+W+S

3.  In this Schedule “appropriate officer" has the meaning it bears in section 36(1).E+W+S

Explanatory Note

(This note is not part of the Order)

This Order provides for the coming into force on 29th November 1999 of further provisions of the Social Security Act 1998 (“the Act") introducing new arrangements for decision-making in relation to income support, the social fund, child’s special allowance and the recovery of benefits from compensation.

The provisions brought into force by article 2 and Schedule 1 relate in particular to the transfer of decision-making functions from adjudication officers to the Secretary of State, from social fund officers to appropriate officers of the Secretary of State and from social security appeal tribunals and medical appeal tribunals to appeal tribunals constituted under Chapter I of Part I of the Act.

Article 3 and Schedules 2 to 20 make consequential amendments in other statutory instruments in so far as they are concerned with, or make reference to, existing arrangements for decision-making and appeals.

Article 4 and Schedules 21 to 23 make transitional provision, in particular as to the manner in which matters are to be dealt with on or after 29th November 1999 which are awaiting determination under the existing srrangements for decision-making and appeals immediately before that date.
