The Secretary of State for Health, in exercise of powers conferred on him by section 126(4) of, and paragraph 2(d) of Schedule 7 to, the National Health Service Act 19771, and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation, commencement and interpretation1

These Regulations may be cited as the Community Health Councils (Amendment) Regulations 1999 and shall come into force on 16th November 1999.

In these Regulations—

  • “the principal Regulations” means the Community Health Councils Regulations 19962.

Amendment of regulation 182

In regulation 18 of the principal Regulations (consultation of Councils by relevant Health Authorities), in paragraph (2), after “trust” insert “or a Primary Care Trust”.

These Regulations amend the Community Health Councils Regulations 1996 to provide that the duty on Health Authorities to consult a Community Health Council on proposals for substantial developments or variations in the health service in the Council’s district (regulation 18(1) of the 1996 Regulations) does not apply to proposals to establish or dissolve a Primary Care Trust in England.
