In these Regulations–

  • “the Act” means the School Standards and Framework Act 1998;

  • “the Transition Regulations” means to Education (School Organisation Proposals) (Transition to New Framework) Regulations 19992;

  • “maintained special school” means a community or foundation special school;

and any reference to section 31, Schedule 6 or Schedule 7 is a reference to that section of, or Schedule to, the Act.

For the purposes of paragraph 4(2) of Schedule 6, in relation to maintained special schools, and these Regulations the date of publication of proposals is–

a

the date on which the requirements of regulation 5 are satisfied; or

b

where different requirements are satisfied on different days, on the last of such days.
