5. In the Merchant Shipping (Prevention of Oil Pollution) Regulations 1996(1), in regulation 1(2) for the definition of “approved” there shall be substituted the following definition:
““approved”–
in relation to any equipment or arrangement other than those mentioned in sub-paragraph (b) below, means approved by the Secretary of State or, in relation to any equipment or arrangement mentioned in Merchant Shipping Notice MSN 1734 or MSN 1735, by a Certifying Authority specified in that Notice in relation to such equipment or arrangement; or
in relation to any equipment or arrangement to which the Merchant Shipping (Marine Equipment) Regulations 1999 apply, means manufactured and tested in accordance with the requirements of those Regulations;”.
