169.—(1) The Royal Charter is amended as follows.
(2) In the first preamble there is added at the end “and Our Scottish Administration”.
(3) In article 2(d) after “Departments of Our Government” there is added “Our Scottish Administration”.
(4) In article 3(a) for “Our Government” there is substituted “Our Scottish Administration”.
(5) In article 5 “including any monies voted by Parliament” is omitted.
(6) In article 12 for “Our Scottish Office” there is substituted “Our Scottish Administration”.
(7) In article 15 “with the approval of the Lords Commissioners of Our Treasury” is omitted.
(8) For article 19(a) there is substituted “references to Our Secretary of State shall be read as if they were references to Our Scottish Ministers”.
(9) In article 19(b) “for Scotland,” is omitted and there is added at the end “and Our Scottish Ministers”.
170. In article 3(c) of the Royal Charter for “Secretary of State for Scotland” in each place where those words appear there is substituted “First Minister”.
171.—(1) The Royal Warrant is amended as follows.
(2) In the 8th paragraph from the end and 5th paragraph from the end for “voted by Our United Kingdom Parliament”, in each place where those words appear, there is substituted “provided by Our Scottish Ministers”.
(3) In the 5th paragraph from the end paragraph “with the consent of Our Treasury” is omitted.
172.—(1) The Royal Charter is amended as follows.
(2) In article 2 (objects of the Council) in paragraph (c) after “Departments of Our Government,” there is inserted “Our Scottish Administration,”.
(3) In article 3 “, including any monies voted by Parliament,” is omitted.
(4) In article 4 (membership)–
(a)in paragraphs (2) to (5) and (8) for “Our Secretary of State”, in each place where these words appear, there is substituted “Our Scottish Ministers”;
(b)in paragraph (3) for “his” there is substituted “their”;
(c)in paragraph (6) for “Our Secretary of State is” and “Our Secretary of State” there is substituted respectively “Our Scottish Ministers are” and “Our Scottish Ministers”; and
(d)in paragraph (8) “with the approval of the Lords Commissioners of Our Treasury” is omitted.
(5) In article 9 (appointment of observer to the Council) for “officer of the Department of Our Secretary of State who is appointed by Our Secretary of State” there is substituted “member of the staff of Our Scottish Administration who is appointed by Our Scottish Ministers”.
(6) In article 10 (appointment etc. of Council staff)–
(a)for “Our Secretary of State”, in each place where those words appear, there is substituted “Our Scottish Ministers”; and
(b)in paragraph (2) “and the Lords Commissioners of Our Treasury”, in each place where those words appear, is omitted.
(7) In article 11 (annual accounts)–
(a)for “Our Secretary of State”, in each place where these words appear, there is substituted “Our Scottish Ministers”; and
(b)“with the approval of the Lords Commissioners of Our Treasury” is omitted.
(8) In article 12 (annual report) for “Our Secretary of State” there is substituted “Our Scottish Ministers”.
(9) Article 15 is omitted.
173.—(1) The Public Appointments Order in Council 1995(1) is amended as follows.
(2) In the preamble, after “Ministers of the Crown”, in both places where those words appear, there is inserted “or a member of the Scottish Executive”.
(3) In article 1, in the definitions of “appointing authority” and “public appointment”, after “a Minister of the Crown”, there is inserted “or a member of the Scottish Executive”.
