Coming into force
In exercise of the powers conferred on the Secretary of State by sections 23(7) and 45(3) of, and paragraph 6 of Schedule 3 and paragraph 3(2) of Schedule 4 to, the School Inspections Act 19961 and section 569(4) and (5) of, and paragraph 3 of Schedule 1 to, the Education Act 19962, the Secretary of State for Wales hereby makes the following Regulations:
Citation, commencement and interpretation1

These Regulations may be cited as the Education (School Inspection) (Wales) (Amendment) Regulations 1999 and shall come into force on 1st September 1999.

In these Regulations “the principal Regulations” means the Education (School Inspection) (Wales) Regulations 19983.
Amendment of Principal Regulations

The principal Regulations shall be amended as follows.

In regulation 5–
a
in both paragraphs (1)(a) and (1)(b) for “county, voluntary or maintained special school” substitute “school maintained by a local education authority”;
b
omit paragraph (1)(c);
c
for paragraph (1)(d) substitute–
in the case of a school which has foundation governors, the person who appoints those governors and, in the case of a voluntary aided school, the appropriate diocesan authority (if different);
d
omit paragraph (1)(e);
e
omit paragraph (1)(f);
f
for paragraph (2)(a), substitute–
the expression “a school which has a delegated budget” shall be construed in accordance with section 49(7)(a) of the School Standards and Framework Act 1998;
g
in paragraph (2)(b) for “section 311 of the Education Act 1996” substitute “section 142(1) of the School Standards and Framework Act 1998”, and omit paragraphs (2)(c) and (2)(d).

In regulation 6(d)(v) for “section 3(2)” substitute “section 6(2)”.

In regulation 12, for the words from “grant-maintained” to “(or both)” substitute “foundation school are required by section 23(1)4 of the 1996 Act to secure that denominational education given to any pupils and the content of the school’s collective worship”.

In regulation 13 omit paragraphs (4)(b) and (c).
