The Lords of Council and Session, under and by virtue of the powers conferred on them by section 5 of the Court of Session Act 19881 and of all other powers enabling them in that behalf, do hereby enact and declare:
Citation and commencement1

This Act of Sederunt may be cited as the Act of Sederunt (Rules of the Court of Session Amendment No. 5) (Miscellaneous) 1999.

This paragraph and paragraph 2(1) to (7) and (9) of this Act of Sederunt shall come into force on 19th May 1999 and paragraph 2(8) of this Act of Sederunt shall come into force on 1st July 1999.

This Act of Sederunt shall be inserted in the Books of Sederunt.
Amendment of the Rules of the Court of Session2

The Rules of the Court of Session 19942 shall be amended in accordance with the following sub-paragraphs.

In Chapter 1—
a
in the heading, for “INTERPRETATION AND FORMS” substitute “ETC.”; and
b
after rule 1.3 add—
Direction relating to Advocate General1.4
The Lord President may, by direction, specify such arrangements as he considers necessary for, or in connection with, the appearance in court of the Advocate General for Scotland.

In rule 3 .6A (registers kept by the Court)—
a
in the heading, the word “3 .6A.” shall cease to have effect; and
b
for “1.5.” substitute “3.6A.”.

In rule 24.2(5) (motions to amend record in terms of minute of amendment etc.), at the end add “; and if it is reasonably practicable to do so, the party shall specify the nature of such further procedure.”.

In rule 37.2 (citation of jurors)—
a
in paragraph (1), for “14” substitute “28”; and

in paragraph (2), for “10” substitute “21”.
