Coming into force
The Lord Chancellor, in exercise of the powers conferred on him by sections 25(2), 34 and 43 of the Legal Aid Act 19881, having had regard to the matters specified in section 34(9), and having consulted the General Council of the Bar and the Law Society, and with the consent of the Treasury, hereby makes the following Regulations:
Citation and commencement1
These Regulations may be cited as the Legal Aid in Criminal and Care Proceedings (Costs) (Amendment) (No. 2) Regulations 1999 and shall come into force on 7th June 1999.
Interpretation2
In these Regulations, any reference to a regulation or Schedule by number alone is a reference to the regulation or Schedule so numbered in the Legal Aid in Criminal and Care Proceedings (Costs) (Regulations) 19892.

In regulation 3(1), “(3), (4) and (5)” shall be substituted for “(3) and (4)”.

The following paragraph shall be inserted after regulation 3(4):

For costs claimed in respect of advice or assistance as to an appeal from the Court of Appeal to the House of Lords, where a petition of appeal is not lodged with the House of Lords, the appropriate authority shall be the Registrar.

In Schedule 3:
a
At the end of paragraph 11(1) there shall be inserted:
but where a fee is also payable under sub-paragraph (1A), an amount equal to that fee shall be deducted from the fee payable under this sub-paragraph.
