Coming into force

The Secretary of State for the Environment, Transport and the Regions as respects England and Wales, and the Secretary of State for Scotland as respects Scotland, in exercise of the powers conferred upon them by sections 93 and 94(1)(c) of the Environment Act 19951, for the implementation of article 6(1) of Directive 94/62/EC2 and of all other powers enabling them in that behalf, after consultation in accordance with section 93(2) of that Act, and having regard to the matters specified in section 93(6) as required by section 93(5) of that Act, hereby make the following Regulations:

Citation and commencement1

These Regulations may be cited as the Producer Responsibility Obligations (Packaging Waste) (Amendment) Regulations 1999 and shall come into force on 4th June 1999.

Amendment of the recovery and recycling targets for 1999 and 20002

Schedule 2 (recovery and recycling obligations) to the Producer Responsibility Obligations (Packaging Waste) Regulations 19973 is amended as follows–

a

at the end of paragraph 4(a), add “and 43% respectively”;

b

in paragraph 4(b), for “43%” substitute “45%”;

c

at the end of paragraph 5(a), add “and 10% respectively”, and

d

in paragraph 5(b), for “11%” substitute “13%”.

These Regulations amend the Producer Responsibility Obligations (Packaging Waste) Regulations 1997, which impose on producers obligations to recover and recycle packaging waste, and related obligations, in order to attain the targets in Article 6(1) of Directive 94/62/EC.

Regulation 2(a) and (b) increase for 1999 and 2000 the recovery targets, used to calculate recovery obligations, from 38% and 43% to 43% and 45% respectively. Regulation 2(c) and (d) increase for 1999 and 2000 the recycling targets, used to calculate recycling obligations, from 7% and 11% to 10% and 13% respectively.
