The Secretary of State, in exercise of the powers conferred on him by sections 7, 10 and 31 of the Misuse of Drugs Act 1971(1), after consultation with the Advisory Council on the Misuse of Drugs, hereby makes the following Regulations:
1. These Regulations may be cited as the Misuse of Drugs (Amendment) Regulations 1998 and shall come into force on 1st May 1998.
2.—(1) The Misuse of Drugs Regulations 1985(2) shall be amended as follows.
(2) In paragraph 1(a) of Schedule 1, there shall be inserted—
(a)after the word “Eticyclidine”, the word “Etryptamine”; and
(b)after the word “Mescaline”, the word “Methcathinone”.
(3) In paragraph 1 of Schedule 2, after the word “Trimeperidine”, there shall be inserted the word “Zipeprol”.
(4) In paragraph 1(a) of Schedule 3, after the word “Ethinamate”, there shall be inserted the word “Flunitrazepam”.
(5) In paragraph 1 of Part II of Schedule 4(3), the word “Flunitrazepam” shall be deleted and there shall be inserted—
(a)after the word “Alprazolam”, the word “Aminorex”;
(b)after the word “Bromazepam”, the word “Brotizolam”; and
(c)after the word “Mefenorex”(4), the word “Mesocarb”.

These Regulations amend the Misuse of Drugs Regulations 1985 by adding Etryptamine and Methcathinone to Schedule 1; Zipeprol to Schedule 2; and Aminorex, Brotizolam and Mesocarb to Schedule 4 Part II. These drugs became subject to control under the Misuse of Drugs Act 1971 by virtue of the Misuse of Drugs Act 1971 (Modification) Order 1998 (S.I. 1998/750). These Regulations also transfer Flunitrazepam from Schedule 4 Part II to Schedule 3 to the 1985 Regulations.
