<Text>The Secretary of State for Health, in exercise of the powers conferred on him by section 5(1) of, and paragraphs 1, 3 to 5 and 6(2)(d) of Schedule 2 to, the National Health Service and Community Care Act 1990<FootnoteRef Ref="f00001"/> and of all other powers enabling him in that behalf, having completed the consultation prescribed under section 5(2) of that Act<FootnoteRef Ref="f00002"/>, and considering it appropriate to include, among the functions of the <Acronym Expansion="National Health Service">NHS</Acronym> trust established by this Order, certain functions in relation to the provision of services by the trust for Health Authorities or Special Health Authorities<FootnoteRef Ref="f00003"/>, hereby makes the following Order:</Text>

<Text>This Order may be cited as the Royal Brompton and Harefield National Health Service Trust (Establishment) Order 1998 and shall come into force on 1st April 1998.</Text>

<Text>In this Order, unless the context otherwise requires—</Text>

<Text>“<Abbreviation Expansion="National Health Service and Community Care Act 1990 c. 19">the Act</Abbreviation>” means the National Health Service and Community Care Act 1990;</Text>

<Text>“the trust” means the Royal Brompton and Harefield National Health Service Trust established by article 2 of this Order.</Text>

<Title>Establishment and name of the trust</Title>

<Text>There is hereby established an NHS trust which shall be called the Royal Brompton and Harefield National Health Service Trust.</Text>
</P1para>
</P1>
</P1group>
<P1group>
<Title>Functions of the trust</Title>
<P1 DocumentURI="http://www.legislation.gov.uk/uksi/1998/784/article/3/made" IdURI="http://www.legislation.gov.uk/id/uksi/1998/784/article/3" id="article-3">
<Pnumber>3</Pnumber>
<P1para>
<Text>The trust’s functions (which include functions which the Secretary of State considers appropriate in relation to the provision of services by the trust for one or more Health Authorities) shall be to provide and manage pursuant to section 5(1)(b) of the Act:</Text>

<Text>the Royal Brompton National Heart and Lung Hospital, Sydney Street, Chelsea, London SW3 6NP,</Text>

<Text>and associated hospitals and facilities, and there to provide hospital accommodation and services (including the management of teaching and research facilities).</Text>

<Title>Directors of the trust</Title>

<Text>The trust shall have, in addition to the chairman, 5 executive directors and 5 non-executive directors.</Text>

<Title>Significant teaching commitment</Title>

<Text>The trust is to be regarded as having a significant teaching commitment by virtue of paragraph 3(2)(b) of Schedule 2 to the Act.</Text>

<Title>Restriction on disposal of assets</Title>

<Text>The sum specified for the purposes of paragraph 6(2)(d) of Schedule 2 to the Act (maximum value of freely disposable assets) in relation to the trust shall be £1,000,000.</Text>
