The London Traffic Control System (Transfer) (Amendment) Order 1998

The Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred by section 101(1) of the Local Government Act 1985(1), and of all other powers enabling him in that behalf, hereby makes the following Order:—

Citation and commencement

1.  This Order may be cited as the London Traffic Control System (Transfer) (Amendment) Order 1998 and shall come into force on 1st April 1998.

Amendment of the London Traffic Control System (Transfer) Order 1988

2.  For article 3 of the London Traffic Control System (Transfer) Order 1988(2) (which authorises the Common Council of the City of London to act as agent for the Secretary of State) there shall be substituted the following article—

Authority of the London borough councils and the Common Council to act as agents for the Secretary of State

3.(1) For the purpose of securing the control, management, development and extension of the London traffic signal and control system, any London borough council may, on its own or jointly with other such councils, act as the agent of the Secretary of State in the control, management, development and extension of that system.

(2) In this article “London borough council” includes the Common Council.

Explanatory Note

(This note is not part of the Order)

Article 3 of the London Traffic Control System (Transfer) Order 1988 authorised the Common Council of the City of London to act as agent of the Secretary of State in the control, management, development and extension of the London traffic signal and control system. This Order substitutes a new article 3 enabling the Common Council or any London borough council alone or jointly to act as his agent.
