The Secretary of State for Wales, in exercise of the powers conferred on him by section 92(1) of the National Health Service Act 1977(1) and of all other powers enabling him in that behalf, having regard to the change in the arrangements for the administration of hospitals and other establishments and facilities formerly managed by Mid Glamorgan District Health Authority(2) resulting from the establishment of Rhondda Health Care National Health Service Trust(3), having consulted Bro Taf Health Authority(4) and that Trust in accordance with section 92(3) of that Act, hereby makes the following Order:—

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Rhondda Health Care National Health Service Trust (Transfer of Trust Property) Order 1998 and shall come into force on 31st March 1998.

(2) In this Order—

“the Authority” means Bro Taf Health Authority;

“the Trust” means Rhondda Health Care National Health Service Trust;

“the trust property” means the items specified in a schedule of trust property prepared by and agreed upon by the Authority and the Trust on 24th June 1997, which schedule has been signed on behalf of the Authority and the Trust.

Transfer of trust property

2.  On 31st March 1998 the trust property shall be transferred from the Authority to the Trust.

Explanatory Note

(This note is not part of the Order)

This Order transfers to Rhondda Health Care National Health Service Trust on 31st March 1998 trust property formerly held by Bro Taf Health Authority. A copy of the schedule of trust property to which the Order refers can be obtained from the Welsh Office, HFM3, New Crown Building, Cathays Park, Cardiff CF1 3NQ.

1977 c. 49; section 92 has been amended by section 11(5) of the National Health Service and Community Care Act 1990 (c. 19) and paragraph 44 of Schedule 1 to the Health Authorities Act 1995 (c. 17) (“the 1995 Act”).

(2)

On 1st April 1996 Mid Glamorgan District Health Authority ceased to exist as a result of the 1995 Act.

See S.I. 1996/146 under which Bro Taf Health Authority was established and S.I. 1996/495 by virtue of which there was transferred to it all trust property held by Mid Glamorgan District Health Authority.
