Coming into force

In exercise of the powers conferred on the Secretary of State by section 144(1) and (3) of the School Standards and Framework Act 19981, the Secretary of State for Education and Employment hereby makes the following Regulations:

Citation and commencement1

These Regulations may be cited as the School Standards and Framework Act 1998 (Modification) (No. 2) Regulations 1998 and shall come into force on 12th January 1999.

Education development plans and intervention by the Secretary of State2

In relation to the period beginning on 1st April 1999 and ending immediately before 1st September 1999—

a

section 6(2)(a)(i) and (3)(b) of the School Standards and Framework Act 1998 (education development plans), and

b

sections 497A(1)(b) and 497B(5) of the Education Act 1996 (intervention by the Secretary of State)2,

shall have effect as if the references (however framed) to schools maintained by the authority included grant-maintained schools and grant-maintained special schools maintained by that authority pursuant to regulation 2 of the School Standards and Framework Act 1998 (Modification) Regulations 19983.

These Regulations modify section 6 of the School Standards and Framework Act 1998 (education development plans) and sections 497A and 497B of the Education Act 1996 (intervention by the Secretary of State) by providing that, in the period beginning on 1st April 1999 and ending immediately before 1st September 1999 the references (however framed) to schools maintained by a local education authority include grant-maintained schools and grant-maintained special schools maintained by that authority.
