The Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred by section 73(1)(a) and (6) of the Civil Aviation Act 19821, and of all other powers enabling him in that behalf, and with the consent of the Treasury in respect of regulation 2(a), hereby makes the following Regulations–

These Regulations may be cited as the Civil Aviation (Joint Financing) (Amendment) Regulations 1998 and shall come into force on 1st January 1999.

The Civil Aviation (Joint Financing) Regulations 19972 shall be amended as follows:

a

in regulation 4(1) for the sums £62.88, £17.80 and £45.08 there shall be substituted respectively the sums £45.69, £9.76 and £35.93;

b

in regulation 15(2) for the figure 22.137% there shall be substituted the figure 14.883%.

These Regulations amend the Civil Aviation (Joint Financing) Regulations 1997 (“the principal Regulations”) as follows–

The charge payable by operators of aircraft to the CAA in respect of crossings between Europe and North America is reduced in consequence of a decision of the Council of the International Civil Aviation Organisation. The element of the charge payable in respect of air navigation services provided by the Government of Denmark is reduced from £17.80 to £9.76. The element of the charge payable in respect of air navigation services provided by the Government of Iceland is reduced from £45.08 to £35.93. The total charge is thus reduced from £62.88 to £45.69 (regulation 2(a)).

The charges are payable in pursuance of the Agreements on the Joint Financing of certain Air Navigation Services respectively in Greenland and the Faroe Islands and in Iceland, opened for signature in Geneva on 25th September 1956 (Cmnd.Nos. 677 and 678) as amended by the Protocols opened for signature at Montreal on 3rd November 1982 (Cmnd.Nos. 8844 and 9945).

In consequence of a decision of the Council of the International Civil Aviation Organisation the sum which is to be deducted by the CAA from the charges received and remitted to that Organisation in respect of air navigation services provided by it is reduced from 22.137% to 14.883% (regulation 2(b)).

The charges are required by the principal Regulations to be remitted to the Governments of Denmark and Iceland subject to the deduction of a fee not exceeding 5 per cent. for the CAA’s expenses in billing and collection.
