Her Majesty, in pursuance of paragraph 19 of Schedule 1 to the Crime (Sentences) Act 19971, including as it applies by section 121(12)(b) of the Crime and Disorder Act 19982, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered as follows:–

This Order may be cited as the Transfer of Prisoners (Isle of Man) (Amendment) Order 1998 and shall come into force on 18th December 1998.

The Transfer of Prisoners (Isle of Man) (No. 2) Order 19973 is amended as follows.

In article 2, for the words from “subject to” onwards substitute “subject to the amendment made to paragraph 6(3) by paragraph 135(2)(b) of Schedule 8 to the Crime and Disorder Act 1998, and to the modifications and supplementary provisions specified in the Schedule to this Order”.

For the sidenote after paragraph 7 of the Schedule substitute “Supplementary provisions”.

Paragraph 9 of the Schedule to the Transfer of Prisoners (Isle of Man) (No. 2) Order 1997 is hereby revoked.

This Order amends the Transfer of Prisoners (Isle of Man) (No. 2) Order 1997 (S.I.1997/1775) to provide for the extension to, and application in relation to, the Isle of Man of the amendment of paragraph 6(3) of Schedule 1 to the Crime (Sentences) Act 1997 (c. 43) (meaning of “recall”) made by paragraph 135(2)(b) of Schedule 8 to the Crime and Disorder Act 1998 (c. 37), being an amendment consequential on other provisions of that Act of 1998. The Order also, in consequence, revokes paragraph 9 of the Schedule to that Order.
