In exercise of the powers conferred on the Secretary of State by sections 408, 537(1) to (8), 539(1) and 569(4) and (5) of the Education Act 1996(1), and after consulting with those persons with whom consultation appeared to him to be desirable, the Secretary of State for Wales hereby makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Education (School Information) (Wales) (Amendment) Regulations 1998 and shall come into force on 1st December 1998.

(2) These Regulations amend the Education (School Information) (Wales) Regulations 1997(2) which are referred to herein as “the Principal Regulations”.

Amendments to the Principal Regulations

2.—(1) Regulation 3 of the Principal Regulations shall be amended as follows.

(2) For the definition of “public examinations” in sub-paragraph (1) there shall be substituted–

“public examinations” means public examinations which are for the time being prescribed by regulations made under section 453(1) of the Act(3);.

3.—(1) Schedule 2 to the Principal Regulations shall be amended as follows.

(2) For sub-paragraph (1) of paragraph 16 there shall be substituted–

(1) Subject to paragraph (3), the information specified in Parts I, II and III of Schedule 1 and in Schedule 2 to the Education (School Performance Information) (Wales) Regulations 1998(4) such information being determined in accordance with Regulation 4 of those Regulations..

(3) Paragraph 23 shall be deleted.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Education (School Information) (Wales) Regulations 1997. The main changes are as follows.

Paragraph 16 of Schedule 2 of the 1997 Regulations is amended in consequence of the repeal and replacement of the regulations referred to in that paragraph by the Education (School Performance Information) (Wales) Regulations 1998. Paragraph 23 of that Schedule is deleted in view of the new duties as to publication of performance targets imposed by the Education (School Performance Targets) (Wales) Regulations 1998 (regulation 3).

1996 c. 56. Section 537(4) is amended by paragraph 37 of Schedule 7 to the Education Act 1997. Sections 408, 537(1) and (7), and 539(1) are prospectively amended by paragraphs 106, 152 and 155 respectively of Schedule 30, and by Schedule 31, to the School Standards and Framework Act 1998 (c. 31). Sections 408 and 537(7) are applied to grant-maintained special schools and their governing bodies by virtue of S.I. 1994/653 and section 539(1) is applied to such schools by S.I. 1994/1048. For the meaning of “prescribed” and “regulations” see section 579(1).
