The A3 Trunk Road (Wandsworth High Street) (Bus Bay Clearway) Order 1998

The Secretary of State for Environment, Transport and the Regions in exercise of the powers conferred on him by sections 6 and 124(1)(d) of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984(1) and of all other powers enabling him in that behalf, hereby makes the following Order:

1.  This Order may be cited as the A3 Trunk Road (Wandsworth High Street) (Bus Bay Clearway) Order 1998 and shall come into force on 26th October 1998.

2.  In this Order–

  • “bus bay clearway” is the length of the westbound carriageway of the trunk road that is between a point 32 metres south east of the south eastern kerbline of Buckhold Road to a point 9 metres north west of the western kerb-line of Garratt Lane (at its junction with the trunk road) and is bounded by road markings of a type shown in diagram 1025.3 of Schedule 6 to the Traffic Signs Regulations 1994(2);

  • “Garratt Lane” and “Buckhold Road” mean the roads of those names in the London Borough of Wandsworth;

  • “London bus service” and “London local service licence” have the same meaning as in Part II of the Transport Act 1985(3);

  • “the trunk road” means that part of the A3 Trunk Road in the London Borough of Wandsworth known as the Wandsworth High Street.

3.  No person shall cause or permit any vehicle to stop or remain at rest at any time in the bus bay clearway.

4.  Nothing in this Order applies to a vehicle being used for the provision of a London bus service–

(a)under a London local service licence; or

(b)for which such a licence is not required by virtue of section 35(2) of 36(1) of the Transport Act 1985(4).

5.  Nothing in this Order applies to–

(a)a vehicle being used–

(i)for fire brigade, ambulance or police purposes;

(ii)for the removal of any obstruction to traffic; or

(iii)in connection with the maintenance, improvement or reconstruction of any road.

6.  Nothing in this Order applies to anything done with the permission or at the direction of a constable in uniform or a traffic warden.

7.  In the Wandsworth (Waiting and Loading Restriction) Order 1976(5) item 142(b)(ii) and item 143(b)(i) of Schedule 2 to that Order shall be deleted in so far as they relate to the bus bay clearway.
