In exercise of the powers conferred upon the Secretary of State by section 100(3) and 102(4) of the School Standards and Framework Act 19981, the Secretary of State for Education and Employment hereby makes the following Regulations:

These Regulations may be cited as the Education (Proportion of Selective Admissions) Regulations 1998 and shall come into force on 1st October 1998.

This regulation has effect for calculating “the proportion of selective admissions”, within the meaning of section 100(3) or (as the case may be) 102(4) of the School Standards and Framework Act 1998, in relation to the admission of pupils in any relevant age group to a maintained school in any school year.

For the purposes of that calculation, the total number of pupils in any such age group admitted to the school in a school year shall be taken to equal the number of pupils in that age group which it is or was intended to admit to the school in that school year.
