Coming into force

The Secretary of State for Wales, in exercise of the powers conferred upon him by section 52(4) of the Local Government (Wales) Act 19941, and of all other powers enabling him in that behalf, hereby makes the following Order:–

Citation, commencement and interpretation1

This Order may be cited as the Local Government Act 1988 (Direct Service Organisations) (Accounts etc.) (Extension) (Wales) (Amendment) Order 1998 and shall come into force on 30th September 1998.

In this Order, “the principal Order” means the Local Government Act 1988 (Direct Service Organisations) (Accounts etc.) (Extension) (Wales) Order 19972.

Amendment of the principal Order2

In article 3 (application of Part I of the Local Government Act 1988 during transitional period) of the principal Order for “31st May 1999” substitute “31st May 2000”.

Revocation3

The Local Government Act 1988 (Direct Service Organisations) (Accounts etc.) (Extension) (Wales) (Amendment) Order 19973 is revoked.

The Local Government Act 1988 (Direct Service Organisations) (Accounts etc.) (Extension) (Wales) Order 1997 (S.I.1997/528), as amended by S.I.1997/1702, (“the principal Order”) provides that section 52(3) of the Local Government (Wales) Act 1994 (application of Part I of the Local Government Act 1988 during transitional period) has effect as if, in relation to the Local Government Act 1988 (Defined Activities) (Exemptions) (Wales) Order 1994 (S.I.1994/339 as amended), the date mentioned in the definition of “exempting order” in section 52(3) were 31st May 1999 instead of 1st April 1997.

Article 2 of the present Order amends the principal Order to substitute the date of 31st May 2000 for that of 31st May 1999. This is in consequence of the further exemption in Wales for Welsh authorities from the competitive tendering requirements under Part I of the Local Government Act 1988 (competition) made by the Local Government Act 1988 (Defined Activities) (Exemptions) (Wales) (Amendment) Order 1998 (S.I.1998/2188).

Article 3 makes a consequential revocation of the Local Government Act 1988 (Direct Service Organisations) (Accounts etc.) (Extension) (Wales) (Amendment) Order 1997 (S.I.1997/1702).
