Coming into force in accordance with article 1

The Secretary of State, in exercise of the powers conferred on him by section 1(1) and (2) and section 24(1) of the Food and Environment Protection Act 19851, and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement1

This Order may be cited as the Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) Order 1998 Partial Revocation (No.3) Order 1998 and shall come into force at 18.00 hours on 1st September 1998.

Revocation2

The Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) Order 19982 insofar as it remains in force is revoked.

This Order revokes insofar as remaining in force the Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) Order 1998 (“the principal Order”) which prohibited–

a

fishing for or taking shellfish within the areas designated in the Schedule to that Order (article 4);

b

movement of such shellfish out of those areas (article 5); and

c

landing, using in the preparation or processing for supply of food of, supplying and other specified activities in relation to, such shellfish from the designated areas within the United Kingdom (article 6).

The effect of this Order is to remove all the removal prohibitions from fishing for, taking, moving, landing, using in food production and supplying shellfish, from the areas designated in the Schedule to the principal Order.
