Coming into force

The Secretary of State, in exercise of the powers conferred on him by sections 2(9) and 15(5) of the Local Government Act 19881, and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement1

This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemptions) (Chiltern District Council, Lewes District Council and Eastbourne Borough Council) Order 1998 and shall come into force on 16th September 1998.

Exemptions of financial services2

The financial services2 work of the council of the district of Chiltern shall not be treated as a defined activity so long as it is carried out during the period beginning with 1st April 1999 and ending on 31st March 2000.

The financial services work of the council of the district of Lewes shall not be treated as a defined activity so long as it is carried out during the period beginning with 1st April 1999 and ending on 31st March 2001.

Exemption of housing management3

The housing management3 work of the council of the borough of Eastbourne shall not be treated as a defined activity so long as it is carried out during the period beginning with 1st April 1999 and ending on 29th March 2000.

Under Part I of the Local Government Act 1988 (competition), work falling within certain defined activities may be carried out by local authorities only if particular conditions are fulfilled.

This Order exempts from the requirements of Part I the financial services work of the district councils of Chiltern and Lewes, so long as it is carried out during the periods mentioned in paragraphs (1) and (2) of article 2 respectively; and (by article 3) the housing management work of Eastbourne Borough Council, so long as it is carried out during the period beginning with 1st April 1999 and ending on 29th March 2000.
