The Secretary of State for Health in exercise of the powers conferred on him by section 92(1) of the National Health Service Act 19771 and of all other powers enabling him in that behalf, having regard to the changes in the arrangements for the administration of hospitals and other establishments and facilities previously managed by the former Exeter Health Authority and the former North Devon Health Authority resulting from the establishment of the National Health Service trusts specified in the Schedule to this Order, having consulted the North and East Devon Health Authority and those National Health Service trusts in accordance with section 92(3) of that Act, hereby makes the following Order:

Citation, commencement and interpretation1.

(1)

This Order may be cited as the North and East Devon Health Authority (Transfers of Trust Property) Order 1998 and shall come into force on 24th February 1998.

(2)

In this Order—

“the Authority” means the North and East Devon Health Authority;

“the Schedule” means the Schedule to this Order;

“the trust property” means, in the case of each National Health Service trust specified in the Schedule, the items specified in a schedule of trust property prepared by, agreed upon by and signed on behalf of the Authority and that National Health Service trust on 13th January 1997.

Transfer of trust property2.

On 24th February 1998, in the case of each National Health Service trust specified in the Schedule, the trust property shall be transferred from the Authority to that National Health Service trust.

(This note is not part of the Order)

This Order transfers on 24th February 1998 to the National Health Service trusts specified in the Schedule to the Order trust property held by the North and East Devon Health Authority. A copy of the Schedule of trust property transferred to each National Health Service trust can be obtained from the Department of Health, Accounts and Trust Allocations Branch, Quarry House, Quarry Hill, Leeds LS2 7UE.
