The Secretary of State for Health, in exercise of the powers conferred on him by section 92(1) of the National Health Service Act 19771 and of all other powers enabling him in that behalf, having regard to the change in the arrangements for the administration of hospitals and facilities previously managed by the former Doncaster Health Authority resulting from the establishment of the Doncaster Royal Infirmary and Montagu Hospital National Health Service Trust2, having consulted the Doncaster Health Authority and that Trust in accordance with section 92(3) of that Act, hereby makes the following Order:

Citation, commencement and interpretation1.

(1)

This Order may be cited as the Doncaster Royal Infirmary and Montagu Hospital National Health Service Trust (Transfer of Trust Property) Order 1998 and shall come into force on 24th February 1998.

In this Order—

“the Authority” means the Doncaster Health Authority;

“the Trust” means the Doncaster Royal Infirmary and Montagu Hospital National Health Service Trust;

“the trust property” means the items specified in a schedule of trust property prepared by, agreed upon by and signed on behalf of the Authority and the Trust on 14th November 1997.

Transfer of trust property2.

On 24th February 1998 the trust property shall be transferred from the Authority to the Trust.

This Order transfers to the Doncaster Royal Infirmary and Montagu Hospital National Health Service Trust on 24th February 1998 trust property held by Doncaster Health Authority.
