The Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred by section 41(1), (2) and (5) of the Road Traffic Act 1988(1) and of all other powers enabling him in that behalf, and after consultation with representative organisations in accordance with section 195(2) of that Act, hereby makes the following Regulations:—

Citation and commencement

1.  These Regulations may be cited as the Road Vehicles (Construction and Use) (Amendment) (No. 5) Regulations 1998 and shall come into force on 1st August 1998.

Preliminary

2.  The Road Vehicles (Construction and Use) Regulations 1986(2) shall be further amended in accordance with the following provisions of these Regulations.

Amendment of regulation 61 (emission of smoke, vapour, gases, oily substances, etc.)

3.—(1) Regulation 61 shall be amended as follows.

(2) In paragraph (10AB)—

(a)for the words “Subject to paragraphs (10AC) and (10B)” there shall be substituted “Subject to paragraph (10B)”; and

(b)in sub-paragraphs (a) and (c) for the words “1st August 1994” in each place where those words occur there shall be substituted “1st August 1995”.

(3) Paragraphs (10AC) and (10BC) shall be omitted.

Amendment of Schedule 7B (emissions from certain motor vehicles)

4.  In Schedule 7B, in paragraph 7 for sub-paragraph (b) there shall be substituted the following sub-paragraph—

(b)“the emissions publication” is the publication entitled “In-Service Exhaust Emissions Standards for Road Vehicles—Fourth Edition” (ISBN 0-9526457-3-4) published by the Department of the Environment, Transport and the Regions.

Explanatory Note

(This note is not part of the Regulations)

These Regulations further amend regulation 61 (emissions) and Schedule 7B of the Road Vehicles (Construction and Use) Regulations 1986.

The principal amendment is that the definition of “the emissions publication” in Schedule 7B is amended so as to refer to the most recent (i.e. the fourth) edition of this publication. This publication specifies with respect to vehicles with spark ignition engines the maximum permitted carbon monoxide content of exhaust emissions at idling speed and the limits for the ratio of air to petrol vapour entering the combustion chamber, in relation to each vehicle model named in the publication.

Regulation 61 is amended by the alteration of certain dates in paragraph (10AB), which defines the scope of paragraph (10AA), and by the revocation as spent of paragraphs (10AC) and (10BC).
