The Secretary of State, in exercise of the powers conferred on him by sections 12A(5), 105(7) and 108(1) of the National Health Service (Scotland) Act 19781, and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation, commencement and interpretation1

These Regulations may be cited as the National Health Service Trusts (Membership and Procedure) (Scotland) Amendment Regulations 1998 and shall come into force on 6th July 1998.

In these Regulations “the principal Regulations” means the National Health Service Trusts (Membership and Procedure) (Scotland) Regulations 19912.

Amendment of the principal Regulations2

In regulation 8 of the principal Regulations (disqualification for appointment: chairman and non-executive directors) paragraph (1)(g) shall be omitted.

These Regulations further amend the National Health Service Trusts (Membership and Procedure) (Scotland) Regulations 1991 (“the principal Regulations”) which make provision concerning the membership and procedure of NHS trusts. Regulation 8(1)(g) of the principal regulations which disqualifies a person holding a paid appointment or office with a trade union which represents the interests of members which are employed by a health service body from being a chairman or non-executive director of an NHS trust is omitted.
