In exercise of the powers conferred on the Secretary of State by sections 19 and 26(4) of the Local Government Act 1992(1) the Secretary of State for Education and Employment hereby makes the following Regulations:—
1.—(1) These Regulations may be cited as the Local Government Changes for England (Disability Statements) Regulations 1998 and shall come into force on 29th June 1998.
(2) In these Regulations a “section 17 order” means an order under section 17 of the Local Government Act 1992.
2. In relation to a local authority, which by or in consequence of a structural change effected by a section 17 order became a local education authority on 1st April 1998 (having not previously been one), regulation 3(1) of the Education (Disability Statements for Local Education Authorities) (England) Regulations 1997(2) shall have effect as if 31st December 1998 were substituted for 15th December 1997.

Section 528 of the Education Act 1996 provides that every local education authority must publish disability statements at prescribed intervals and by virtue of regulation 3(1) of the Education (Disability Statements for Local Education Authorities) (England) Regulations 1997 the first disability statements must be published by 15th December 1997. These regulations make provision for local authorities which in consequence of a structural change effected by an order under section 17 of the Local Government Act 1992 become local education authorities on 1st April 1998. Such authorities must publish their first disability statement by 31st December 1998.
