Coming into force
The Lord Chancellor and the Lord Advocate, in exercise of their powers under section 19(5) of the Nurses, Midwives and Health Visitors Act 19971, and as respects proceedings in England and Wales and in Scotland, respectively, hereby approve the Nurses, Midwives and Health Visitors (Professional Conduct) (Amendment) Rules 1998 made by the United Kingdom Central Council for Nursing, Midwifery and Health Visiting and set out in the Schedule hereto.
This Order may be cited as the Nurses, Midwives and Health Visitors (Professional Conduct) (Amendment) Rules 1998 Approval Order 1998 and shall come into force on 18th May 1998.
SCHEDULEThe Nurses, Midwives and Health Visitors (Professional Conduct) (Amendment) Rules 1998 made by the United Kingdom Central Council for Nursing, Midwifery and Health Visiting under the Nurses, Midwives and Health Visitors Act 1997
The United Kingdom Central Council for Nursing, Midwifery and Health Visiting, in exercise of the powers conferred on it by section 10 of the Nurses, Midwives and Health Visitors Act 19972, hereby makes the following rules—
Citation, Interpretation and Transitional Provision1

These rules may be cited as the Nurses, Midwives and Health Visitors (Professional Conduct) (Amendment) Rules 1998.

For the purposes of these rules “the Professional Conduct rules” means the Nurses, Midwives and Health Visitors (Professional Conduct) Rules 19933.

These rules shall apply in respect of a person removed from the register on or after the date of the commencement of these rules and any person removed from the register for a specified period before that date shall be treated as if these rules had not come into force.
Amendment of the Professional Conduct rules2

The Professional Conduct rules shall be amended in accordance with the following paragraphs of this rule.

In rule 2—
a
in paragraph (4) the words “in accordance with rule 22(1), or” shall be deleted; and
b
in paragraph (5) the words “in accordance with rule 49(1) or” shall be deleted.

In rule 18(4) before the word “guilty” there shall be added the word “not”.

In rule 22—
a
paragraph (1) shall be deleted; and
b
in paragraph (2) the words “, for an unspecified period,” shall be deleted.

In rule 49—
a
paragraph (1) shall be deleted; and
b
in paragraph (2) the words “, for an unspecified period,” where they twice appear shall be deleted.
