were civil partners if, but only if, they would be regarded as living together as husband and wife were they instead two people of the opposite sex.</Repeal></Repeal></Text></P2para></P2><P2 these Regulations—</Text></P2para><P2para><Text>“the 1995 Act" means the <Substitution ChangeId="key-430c853bef51b06e5a848123a595c970-1479915301965" CommentaryRef="key-430c853bef51b06e5a848123a595c970">Pensions</Substitution> Act 1995;</Text></P2para><P2para><Text>“the 1993 Act" means the Pension Schemes Act 1993;</Text></P2para><P2para><Text><CommentaryRef Ref="key-a3d0865bd88a3b9a94db733b3d3d1f31"/>...</Text></P2para><P2para><Text>“pensionable age" has the same meaning as in section 181 of the 1993 Act <CommentaryRef Ref="c1681096"/>;</Text></P2para><P2para><Text>“relevant scheme" has the same meaning as in  <Substitution ChangeId="key-dc17a0ccab3f4a4fc0c8c57e9b77c4db-1565170618423" CommentaryRef="key-dc17a0ccab3f4a4fc0c8c57e9b77c4db">section 37A</Substitution>  of the 1993 Act <CommentaryRef Ref="c1681097"/>;</Text></P2para><P2para><Text>“supplementary credits" has the same meaning as in section 75 of the 1993 Act; and</Text></P2para><P2para><Text>“trustees", in relation to an occupational pension scheme which is not set up or established under a trust, means the Act.</Substitution></Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2014-01-01"><Title> Conditions on which policies of insurance and annuity contracts may be assigned or surrendered</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/1997/784/regulation/3" IdURI="http://www.legislation.gov.uk/id/uksi/1997/784/regulation/3" id="regulation-3"><Pnumber>3</Pnumber><P1para><Text>The conditions referred to in section 19(4)(b) of the 1993 Act (policy of insurance or annuity contract appropriate for the purposes if it may not be assigned or surrendered except on conditions which satisfy prescribed requirements) are—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1997/784/regulation/3/a" IdURI="http://www.legislation.gov.uk/id/uksi/1997/784/regulation/3/a" id="regulation-3-a"><Pnumber>a</Pnumber><P3para><Text>that the written consent of the earner or, if the earner has died, the earner’s  <Substitution ChangeId="key-5bbca1dfb455149230fd028ad44230c9-1511967457363" CommentaryRef="key-5bbca1dfb455149230fd028ad44230c9">widow, widower or surviving civil partner</Substitution>  to the assignment or surrender is obtained; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1997/784/regulation/3/b" IdURI="http://www.legislation.gov.uk/id/uksi/1997/784/regulation/3/b" id="regulation-3-b"><Pnumber>b</Pnumber><P3para><Text>that in consideration of the assignment or surrender the benefits previously secured by the policy of insurance or annuity contract become secured, or are replaced by benefits which are secured, by one or more of the following means—</Text><P4 DocumentURI="http://www.legislation.gov.uk/uksi/1997/784/regulation/3/b/i" IdURI="http://www.legislation.gov.uk/id/uksi/1997/784/regulation/3/b/i" id="regulation-3-b-i"><Pnumber>i</Pnumber><P4para><Text>another policy of insurance or annuity contract which is appropriate within the meaning of section 19(4) of the 1993 Act,</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/1997/784/regulation/3/b/ii" IdURI="http://www.legislation.gov.uk/id/uksi/1997/784/regulation/3/b/ii" id="regulation-3-b-ii"><Pnumber>ii</Pnumber><P4para><Text>subject to regulations 3, 5 and 6 of the Contracting-out (Transfer and Transfer Payment) Regulations 1996 <CommentaryRef Ref="c1681101"/> in the case of benefits which include guaranteed minimum pensions, the award of supplementary credits under an occupational pension scheme which applies to the employment of the earner at the time of the assignment or surrender or the granting of rights to money purchase benefits under a personal pension scheme, or</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/1997/784/regulation/3/b/iii" IdURI="http://www.legislation.gov.uk/id/uksi/1997/784/regulation/3/b/iii" id="regulation-3-b-iii"><Pnumber>iii</Pnumber><P4para><Text>in the case only of benefits which are not, and do not include guaranteed minimum pensions, the award of rights to money purchase benefits RestrictStartDate="2014-04-06"><Title> Further conditions on which liability may be discharged</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/1997/784/regulation/6" IdURI="http://www.legislation.gov.uk/id/uksi/1997/784/regulation/6" id="regulation-6"><Pnumber>6</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/784/regulation/6/1" IdURI="http://www.legislation.gov.uk/id/uksi/1997/784/regulation/6/1" id="regulation-6-1"><Pnumber>1</Pnumber><P2para><Text>The conditions referred to in section 19(5)(c)(ii) of the 1993 Act (further conditions on which liability may be discharged) are that the requirements of one or more of paragraphs (2) to (5) are satisfied.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/784/regulation/6/2" IdURI="http://www.legislation.gov.uk/id/uksi/1997/784/regulation/6/2" id="regulation-6-2"><Pnumber>2</Pnumber><P2para><Text>The requirements of this paragraph are satisfied if—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1997/784/regulation/6/2/a" IdURI="http://www.legislation.gov.uk/id/uksi/1997/784/regulation/6/2/a" id="regulation-6-2-a"><Pnumber>a</Pnumber><P3para><Text>the earner is dead and benefit is payable to a person other than  <Substitution ChangeId="key-4b3ff2881a06c9a516f3ada6df434f4e-1511968394330" CommentaryRef="key-4b3ff2881a06c9a516f3ada6df434f4e">the earner’s widow, widower or surviving civil partner</Substitution>; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1997/784/regulation/6/2/b" IdURI="http://www.legislation.gov.uk/id/uksi/1997/784/regulation/6/2/b" id="regulation-6-2-b"><Pnumber>b</Pnumber><P3para><Text>the arrangement for securing the benefit by means of the policy or contract was made at the written request of the person entitled to it, or with the consent of that person given in writing in the form set out in Schedule 1 to these Regulations.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/784/regulation/6/3" IdURI="http://www.legislation.gov.uk/id/uksi/1997/784/regulation/6/3" id="regulation-6-3"><Pnumber>3</Pnumber><P2para><Text>The requirements of this paragraph are satisfied if the benefit is provided as an alternative to short service benefit by virtue of a provision that conforms with the requirements of regulation 9(4) of the Occupational Pension Schemes (Preservation of Benefit) Regulations 1991 (bought out benefits without consent)<CommentaryRef Ref="c1681105"/>.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/784/regulation/6/4" IdURI="http://www.legislation.gov.uk/id/uksi/1997/784/regulation/6/4" id="regulation-6-4"><Pnumber>4</Pnumber><P2para><Text>In a case where an occupational pension scheme is being wound up and sections 73 and 74 of the 1995 Act and regulations made under those sections do not apply, the requirements of this paragraph are satisfied if the earner is able to assign or surrender the policy of insurance or annuity contract and the conditions specified in regulation 3 are satisfied.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/784/regulation/6/5" IdURI="http://www.legislation.gov.uk/id/uksi/1997/784/regulation/6/5" id="regulation-6-5"><Pnumber>5</Pnumber><P2para><Text>The requirements of this paragraph are satisfied if the conditions set out in sub-paragraphs (a) and (b) are satisfied, namely—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1997/784/regulation/6/5/a" IdURI="http://www.legislation.gov.uk/id/uksi/1997/784/regulation/6/5/a" id="regulation-6-5-a"><Pnumber>a</Pnumber><P3para><Text>the benefit concerned includes a guaranteed minimum pension that is payable to the earner’s  <Substitution ChangeId="key-32709f1d3eec28176ddda0b4ce192bf0-1511968441676" CommentaryRef="key-32709f1d3eec28176ddda0b4ce192bf0">widow, widower or surviving civil partner</Substitution>;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1997/784/regulation/6/5/b" IdURI="http://www.legislation.gov.uk/id/uksi/1997/784/regulation/6/5/b" id="regulation-6-5-b"><Pnumber>b</Pnumber><P3para><Text>the trustees—</Text><P4 DocumentURI="http://www.legislation.gov.uk/uksi/1997/784/regulation/6/5/b/i" IdURI="http://www.legislation.gov.uk/id/uksi/1997/784/regulation/6/5/b/i" id="regulation-6-5-b-i"><Pnumber>i</Pnumber><P4para><Text>give the  <Substitution ChangeId="key-32709f1d3eec28176ddda0b4ce192bf0-1511968468634" CommentaryRef="key-32709f1d3eec28176ddda0b4ce192bf0">widow, widower or surviving civil partner</Substitution>  at least 30 days written notice (“the notice") of their intention to take out the insurance policy or enter into the annuity contract, and</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/1997/784/regulation/6/5/b/ii" IdURI="http://www.legislation.gov.uk/id/uksi/1997/784/regulation/6/5/b/ii" id="regulation-6-5-b-ii"><Pnumber>ii</Pnumber><P4para><Text>send the notice to the  <Substitution ChangeId="key-32709f1d3eec28176ddda0b4ce192bf0-1511968505450" CommentaryRef="key-32709f1d3eec28176ddda0b4ce192bf0">widow, widower or surviving civil partner</Substitution>   <Substitution ChangeId="key-94db4f2ed169681bf97d1a6c630d46cb-1565166984425" CommentaryRef="key-94db4f2ed169681bf97d1a6c630d46cb">in accordance with regulations 26 to 28 of the Occupational and Personal Pension Schemes (Disclosure of Information) Regulations 2013 (giving information and documents)</Substitution>  or deliver the notice to the  <Substitution ChangeId="key-32709f1d3eec28176ddda0b4ce192bf0-1511968532328" CommentaryRef="key-32709f1d3eec28176ddda0b4ce192bf0">widow, widower or surviving civil partner</Substitution>  personally.</Text></P4para></P4></P3para></P3></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2014-01-01"><Title> Form of consent</Title><P1 purpose of section 19(5)(a)(ii) of the 1993 Act (form of consent to arrangements for securing benefits) the prescribed form is the form set out in Schedule 1 to these trustees of a relevant scheme are prohibited or restricted from discharging any liability to provide pensions under a relevant scheme except—</Text><P3 RestrictStartDate="2021-04-06"><Title> Circumstances in which liability to provide pensions under a relevant scheme may be discharged</Title><P1 pension or annuity is in payment at the date of the beneficiary’s death at least 50 per cent. of the annual rate attributable to pensions and accrued rights under the relevant scheme which was in Pension Schemes (Discharge of Liability) Regulations 1997 (“the Regulations") consolidate the Occupational Pension Schemes (Discharge of Liability) Regula tions 1985 with minor and drafting amendments and make provision in respect of pensions and accrued rights under a scheme contracted out by virtue of section 9(2B) of the Pension Schemes Act 1993 so far as is attributable to an earner’s service on or after 6th April 1997.</Text></Para></BlockText></P><P><BlockText><Para><Text>Regulations 2 and 5 prescribe the requirements which apply to policies of insurance and annuity contracts for the purposes of discharging liability.</Text></Para></BlockText></P><P><BlockText><Para><Text>Regulations 3 and 4 prescribe the conditions on which policies of insurance and annuity contracts may be assigned or surrendered or commuted.</Text></Para></BlockText></P><P><BlockText><Para><Text>Regulation 6 prescribes further conditions on which liability may be discharged.</Text></Para></BlockText></P><P><BlockText><Para><Text>Regulation 7 and Schedule 1 set out the form of consent to the arrangements for securing benefits.</Text></Para></BlockText></P><P><BlockText><Para><Text>Part III makes provision in respect of the discharge of liability to provide pensions under a scheme contracted-out by virtue of section 9(2B) of the Pension Schemes Act 1993 (“the relevant scheme"). Regulations 8, 9 and 11 provide the circumstances in which and conditions on which the discharge of liability to provide pensions under a relevant scheme may occur.</Text></Para></BlockText></P><P><BlockText><Para><Text>Regulation 10 defines the meaning of “transaction" for the purposes of regulation 9.</Text></Para></BlockText></P><P><BlockText><Para><Text>Regulation 12 and Schedule 2 provide for revocations.</Text></Para></BlockText></P><P><BlockText><Para><Text>An assessment of the cost compliance for employers of the measures arising from the Pensions Act 1995, including regulations, has been placed in the libraries of both Houses of Parliament.
