Coming into force

In exercise of the powers conferred upon me by paragraph 2(3) of Schedule 1 to the Nurses, Midwives and Health Visitors Act 19791 and having approved the variation to the electoral scheme prepared and submitted to me by the United Kingdom Central Council for Nursing, Midwifery and Health Visiting under paragraph 2(1) of that Schedule, I hereby give effect to the variation to the scheme which is set out in the Schedule to this Order.

This Order may be cited as the United Kingdom Central Council for Nursing, Midwifery and Health Visiting (Electoral Scheme) Variation Order 1997 and shall come into force on 1st April 1997.

SCHEDULERULES MADE BY THE UNITED KINGDOM CENTRAL COUNCIL FOR NURSING, MIDWIFERY AND HEALTH VISITING AND APPROVED BY THE SECRETARY OF STATE

The United Kingdom Central Council for Nursing, Midwifery and Health Visiting, in exercise of the powers conferred on it by paragraph 2(1) of Schedule 1 of the Nurses, Midwives and Health Visitors Act 19792 (hereinafter referred to as “the Act”) hereby makes the following Rules:–

Citation and Interpretation1

These rules may be cited as the Nurses, Midwives and Health Visitors Electoral Scheme (Variation) Rules 1997.

In these rules, “the Electoral Scheme Rules” means the Nurses, Midwives and Health Visitors (Electoral Scheme) Rules 1992.

Amendment of the Electoral Scheme Rules2

The Electoral Scheme Rules shall be varied as follows.

In rule 1 –

a

in paragraph (2) –

i

the definition of “effective registration” shall be deleted;

ii

in the definition of “Registrar”, for the words “Registrar and Chief Executive” there shall be substituted the words “Chief Executive/Registrar”;

b

paragraph (4) shall be deleted.

In rule 5(1) for the words “have effective registration” there shall be substituted the words “are registered”.

In rule 6(2) –

a

in sub-paragraph (b) for the word “seconded” there shall be substituted the word “supported”;

b

in sub-paragraph (d) –

i

for the words “have effective registration” there shall be substituted the words “be registered”;

ii

for the word “Register” shall be substituted the word “register”.

In rule 8 –

a

for paragraph (2) there shall be substituted the following –

A candidate shall be nominated by one person and supported by 9 others, each of whom shall –

a

be included in the Electoral Roll;

b

satisfy the same criterion as specified in rule 6(2)(d) as is satisfied by the candidate nominated or supported; and

c

reside or work, on the date specified by the Council under rule 5(1) in the country in relation to which the candidate nominated or supported seeks election.

in sub-paragraph (3)(e), for the word “seconder” there shall be substituted the word “supporters”.

In rule 14 for the word “seconders” there shall be substituted the word “supporters”.

In Appendix II

a

the reference to Rules at the top of the Appendix shall read “Rules 1(2), 4(3), 9(7) and 10”;

b

in sub-paragraph 2(5) after the words “candidate with the” insert the word “next”.

This Order gives effect to rules for the variation to the electoral scheme prepared by the United Kingdom Central Council for Nursing, Midwifery and Health Visiting.

The rules make minor variation to the electoral scheme approved by Secretary of State in the United Kingdom Central Council for Nursing, Midwifery and Health Visiting (Electoral Scheme) Order 1992 (S.I.1992/2159).

To take account of the changes made by the Nurses, Midwives and Health Visitors (Periodic Registration) Amendment Rules 1995 approved by S.I.1995/967, rules 1, 5(1) and 6(2)(d) have been varied to reflect the introduction of periodic registration. Rule 8(2) has been altered to increase the number of persons required to support a nomination from one to nine and to correct an earlier drafting error. Consequential amendments have been made to rule 6(2)(b), 8(3)(e) and 14.

Finally, paragraph 2(5) of Appendix II has been varied to correct an earlier drafting error.
