39. In section 217(1)—
(a)paragraph (a) is hereby repealed, and
(b)for paragraph (d) there shall be substituted—
“(d)in relation to any other statutory undertakers or the Civil Aviation Authority, the Secretary of State for the Environment, Transport and the Regions.”
