<Text>Now, therefore, in exercise of the powers conferred by section 2(1) of the Parks Regulation (Amendment) Act 1926<FootnoteRef Ref="f00002"/> as extended by section 7(5) of the Crown Estate Act 1961<FootnoteRef Ref="f00003"/> and now vested in her<FootnoteRef Ref="f00004"/>, the Secretary of State hereby makes the following Regulations:—</Text>

Ref="key-049b3d795df0afae7757499afd02640a"/>1</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/1/1" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/1/1" id="regulation-1-1"><Pnumber>1</Pnumber><P2para><Text>These Regulations may be cited as the Royal Parks and Other Open Spaces Regulations 1997 and shall come into force on 1st October 1997.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/1/2" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/1/2" id="regulation-1-2"><Pnumber>2</Pnumber><P2para><Text>In these Regulations:—</Text><UnorderedList Decoration="none"><ListItem><Para><Text>“constable” includes a park constable within the meaning of section 3 of the Parks Regulation Act 1872<FootnoteRef Ref="f00005"/> as amended by the Parks Regulation (Amendment) Act 1974<FootnoteRef Ref="f00006"/>;</Text></Para></ListItem><ListItem><Para><Text>“Palace” means Buckingham Palace, Hampton Court Palace or St. James’s Palace;</Text></Para></ListItem><ListItem><Para><Text>“Park” means an area of land described in Schedule 1 to these Regulations;</Text></Para></ListItem><ListItem><Para><Text>“Park road” means a road, which is for the time being open to vehicular traffic, in a Park;</Text></Para></ListItem><ListItem><Para><Text> <Addition ChangeId="key-e0d967dc37ead89b4e76bf2a9456544f-1685524414360" CommentaryRef="key-e0d967dc37ead89b4e76bf2a9456544f">“private hire vehicle” means a vehicle licensed under section 7 of the Private Hire Vehicles (London) Act 1998;</Addition> </Text></Para></ListItem><ListItem><Para><Text>“taxi” means a vehicle licensed under section 6 of the Metropolitan Carriage Act 1869<FootnoteRef Ref="f00007"/>;</Text></Para></ListItem><ListItem><Para><Text>“the public speaking area” means that part of Hyde Park bounded by Cumberland Gate and North Carriage Drive on the north, Stanhope Walk on the west, Grosvenor Walk on the south, and the Broad Walk on the east, including the area known as Speakers' Corner;</Text></Para></ListItem><ListItem><Para><Text>“the riding ways” means—</Text><OrderedList Decoration="parens" Type="alpha"><ListItem><Para><Text>in relation to Hyde Park, the Park roads therein and the horse rides known as the Dorchester Ride, the Ladies' Mile, the New Ride, the North Ride, Rotten Row and the Serpentine Ride, and</Text></Para></ListItem><ListItem><Para><Text>in relation to St. James’s and The Green Parks, the Park roads therein and the horse rides known as Constitution Hill Ride and the Mall Ride.</Text></Para></ListItem></OrderedList></Para></ListItem></UnorderedList></P2para></P2></P1para></P1></P1group><P1group RestrictExtent="E+W" RestrictStartDate="1997-10-01"><Title>Restriction on use of a Park</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/2" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/2" id="regulation-2"><Pnumber><CommentaryRef Ref="key-343a100bd879a983b01f5a5a0fae7f05"/>2</Pnumber><P1para><Text>No person, without the written permission of the Secretary of State, shall—</Text><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/2/1" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/2/1" id="regulation-2-1"><Pnumber>1</Pnumber><P2para><Text>be in a Park, or any part thereof, at a time when that Park or part thereof is not open to the public;</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/2/2" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/2/2" id="regulation-2-2"><Pnumber>2</Pnumber><P2para><Text>except in an emergency, land a helicopter or other aircraft in a Park or enter a Park therefrom; or</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/2/3" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/2/3" id="regulation-2-3"><Pnumber>3</Pnumber><P2para><Text>permit any animal of which he is in charge to be in any Park or part thereof in contravention of a notice exhibited by order of the Secretary of State.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictExtent="E+W" RestrictStartDate="2010-04-06"><Title>Acts prohibited in a Park</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/3" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/3" id="regulation-3"><Pnumber><CommentaryRef Ref="key-97a1acb3a19cd56967f980878c9d8019"/>3</Pnumber><P1para><Text>Subject to the provisions of regulation 6, no person using a Park shall—</Text><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/3/1" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/3/1" id="regulation-3-1"><Pnumber>1</Pnumber><P2para><Text>intentionally or recklessly interfere with the safety, comfort or convenience of any person using a Park in accordance with these Regulations;</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/3/2" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/3/2" id="regulation-3-2"><Pnumber>2</Pnumber><P2para><Text>deposit waste, litter or any other article into, or do any act which pollutes or is likely to pollute water in, any fountain, lake, pond or river;</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/3/3" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/3/3" id="regulation-3-3"><Pnumber>3</Pnumber><P2para><Text>drop or leave litter or refuse except in a receptacle provided for the purpose;</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/3/4" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/3/4" id="regulation-3-4"><Pnumber>4</Pnumber><P2para><Text> <Addition ChangeId="key-6b8ff11193ef2fbe676fd1672ca4de65-1685523678644" CommentaryRef="key-6b8ff11193ef2fbe676fd1672ca4de65">unless he is a child of 10 years of age or under,</Addition> use—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/3/4/a" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/3/4/a" id="regulation-3-4-a"><Pnumber>a</Pnumber><P3para><Text>any pedal cycle, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/3/4/b" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/3/4/b" id="regulation-3-4-b"><Pnumber>b</Pnumber><P3para><Text>any roller skate, roller blade, skate board or other foot-propelled device</Text></P3para></P3><Text>except on a Park road or in an area designated and marked as being for that purpose by the Secretary of State;</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/3/5" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/3/5" id="regulation-3-5"><Pnumber>5</Pnumber><P2para><Text>fail to keep any animal of which he is in charge under control or on a lead—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/3/5/a" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/3/5/a" id="regulation-3-5-a"><Pnumber>a</Pnumber><P3para><Text>after having been required by a constable to do so, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/3/5/b" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/3/5/b" id="regulation-3-5-b"><Pnumber>b</Pnumber><P3para><Text>in contravention of a notice exhibited by order of the Secretary of State;</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/3/6" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/3/6" id="regulation-3-6"><Pnumber><Substitution ChangeId="key-e7364821705248b3e223f564a0600d10-1685523728154" CommentaryRef="key-e7364821705248b3e223f564a0600d10">6</Substitution></Pnumber><P2para><Text><Substitution ChangeId="key-e7364821705248b3e223f564a0600d10-1685523728154" CommentaryRef="key-e7364821705248b3e223f564a0600d10">unless the person is a registered blind person, without reasonable excuse, fail to remove immediately any faeces deposited by any animal  </Substitution><Substitution ChangeId="key-e7364821705248b3e223f564a0600d10-1685523728154" CommentaryRef="key-e7364821705248b3e223f564a0600d10"><Addition ChangeId="key-b0b342897cdc2cebc0f05a5df6fc32ef-1685524797617" CommentaryRef="key-b0b342897cdc2cebc0f05a5df6fc32ef">(other than a horse)</Addition></Substitution><Substitution ChangeId="key-e7364821705248b3e223f564a0600d10-1685523728154" CommentaryRef="key-e7364821705248b3e223f564a0600d10"> of which he is in charge, provided always that it shall not be a reasonable excuse that a person in charge of an animal did not have with him any means of removal of the faeces;</Substitution></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/3/7" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/3/7" id="regulation-3-7"><Pnumber>7</Pnumber><P2para><Text>permit any animal of which he is in charge to be tethered or to graze;</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/3/8" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/3/8" id="regulation-3-8"><Pnumber>8</Pnumber><P2para><Text>fail to remove any animal of which he is in charge from a Park or place in that Park after having been required by a constable to do so;</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/3/9" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/3/9" id="regulation-3-9"><Pnumber>9</Pnumber><P2para><Text>fail to comply with any direction for the regulation or control of—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/3/9/a" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/3/9/a" id="regulation-3-9-a"><Pnumber>a</Pnumber><P3para><Text>horses or pedal cycles, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/3/9/b" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/3/9/b" id="regulation-3-9-b"><Pnumber>b</Pnumber><P3para><Text>roller skates, roller blades, skate boards or other foot-propelled devices</Text></P3para></P3><Text>given by a constable or by a notice exhibited by order of the Secretary of State;</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/3/10" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/3/10" id="regulation-3-10"><Pnumber>10</Pnumber><P2para><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/3/10/a" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/3/10/a" id="regulation-3-10-a"><Pnumber>a</Pnumber><P3para><Text>ride any animal,</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/3/10/b" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/3/10/b" id="regulation-3-10-b"><Pnumber>b</Pnumber><P3para><Text>drive or ride any vehicle, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/3/10/c" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/3/10/c" id="regulation-3-10-c"><Pnumber>c</Pnumber><P3para><Text>use any pedal cycle, roller skate, roller blade, skate board or other foot-propelled device</Text></P3para></P3><Text>in any manner that endangers or is likely to endanger any person;</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/3/11" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/3/11" id="regulation-3-11"><Pnumber>11</Pnumber><P2para><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/3/11/a" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/3/11/a" id="regulation-3-11-a"><Pnumber>a</Pnumber><P3para><Text>use a pedal cycle (other than when it is parked), or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/3/11/b" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/3/11/b" id="regulation-3-11-b"><Pnumber>b</Pnumber><P3para><Text>drive or ride a vehicle</Text></P3para></P3><Text>between sunset and sunrise, or in seriously reduced visibility between sunrise and sunset, unless it is lit in accordance with the Road Vehicles (Lighting) Regulations 1989<FootnoteRef Ref="f00008"/>, and for the purposes of this regulation references in the Road Vehicles (Lighting) Regulations 1989 to a road shall be deemed to be references to a Park road or any other area designated and marked as being an area in which a pedal cycle may be used;</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/3/12" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/3/12" id="regulation-3-12"><Pnumber>12</Pnumber><P2para><Text>drive or ride any vehicle off a Park road except—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/3/12/a" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/3/12/a" id="regulation-3-12-a"><Pnumber>a</Pnumber><P3para><Text>for the purpose of parking that vehicle in a place reserved for that id="regulation-3-12-c"><Pnumber>c</Pnumber><P3para><Text>a vehicle in use for the purpose of transacting business with any person either residing in a Palace or Park or using land therein under licence from the Secretary of State</Text></P3para></P3><Text>provided in the case of sub-paragraphs (b) and (c) above that the said vehicle is not driven at a speed exceeding 15 id="regulation-3-15"><Pnumber>15</Pnumber><P2para><Text>fail to move any chair, stand or platform in the public speaking area in Hyde Park in accordance with a direction given by a CommentaryRef="key-c8e8bb9bb918a9be450f86568316e9b7">using any tent or other such structure in a designated park for the purpose of sleeping or staying in that area;</Addition></Text></P3para></P3><P3 ChangeId="key-c8e8bb9bb918a9be450f86568316e9b7-1685525205195" CommentaryRef="key-c8e8bb9bb918a9be450f86568316e9b7">d</Addition></Pnumber><P3para><Text><Addition ChangeId="key-c8e8bb9bb918a9be450f86568316e9b7-1685525205195" CommentaryRef="key-c8e8bb9bb918a9be450f86568316e9b7">placing or keeping in place in a designated park any sleeping equipment with a view to its use (whether or not by the person placing it or keeping it in place) for the purpose of sleeping overnight in that area; and</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/3A/2/e" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/3A/2/e" id="regulation-3A-2-e"><Pnumber><Addition ChangeId="key-c8e8bb9bb918a9be450f86568316e9b7-1685525205195" CommentaryRef="key-c8e8bb9bb918a9be450f86568316e9b7">e</Addition></Pnumber><P3para><Text><Addition ChangeId="key-c8e8bb9bb918a9be450f86568316e9b7-1685525205195" CommentaryRef="key-c8e8bb9bb918a9be450f86568316e9b7">using any sleeping equipment in a designated park for the purpose of sleeping id="regulation-4-4"><Pnumber>4</Pnumber><P2para><Text>attach any article to, climb or interfere with any tree, railing, fence, statue, seat, building or structure;</Text></P2para></P2><P2 id="regulation-4-5"><Pnumber>5</Pnumber><P2para><Text>interfere with any notice or sign;</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/4/6" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/4/6" id="regulation-4-6"><Pnumber>6</Pnumber><P2para><Text>carry on any trade or business in a Park, offer anything for sale or hire or expose or have in his possession anything for the purpose of sale or hire therein;</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/4/7" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/4/7" id="regulation-4-7"><Pnumber>7</Pnumber><P2para><Text>use language which publicly intimates that any article, commodity, facility or service can be obtained in a Park or elsewhere;</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/4/8" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/4/8" id="regulation-4-8"><Pnumber>8</Pnumber><P2para><Text>exhibit any notice or advertisement or any other written or pictorial matter <Addition ChangeId="key-57710b75d0f9fe86d3c4a8755e6ec296-1685524869158" CommentaryRef="key-57710b75d0f9fe86d3c4a8755e6ec296">(other than a notice or advertisement approved by Transport for id="regulation-4-26"><Pnumber>26</Pnumber><P2para><Text>cause or permit any animal to be in a place for the time being marked by buoys or other means as reserved for bathing or to be in any boat on any water in a Park;</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/4/27" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/4/27" id="regulation-4-27"><Pnumber>27</Pnumber><P2para><Text>drive or ride any vehicle which is constructed, adapted or in use for the purpose of a trade or business except as specified in Part I of Schedule 2 to these Regulations;</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/4/28" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/4/28" id="regulation-4-28"><Pnumber>28</Pnumber><P2para><Text>drive or ride any vehicle on a Park road in excess of the speed specified in relation to that road in Part II of Schedule 2 to these Regulations;</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/4/29" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/4/29" id="regulation-4-29"><Pnumber>29</Pnumber><P2para><Text>tow or leave any caravan;</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/4/30" IdURI="http://www.legislation.gov.uk/id/uksi/1997/1639/regulation/4/30" id="regulation-4-30"><Pnumber>30</Pnumber><P2para><Text>unless in an emergency, cause any vehicle to wait, or leave any vehicle unattended, in a place other than one for the time being appointed for the parking of a vehicle of that description by the Secretary of State;</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1997/1639/regulation/4/31" CommentaryRef="key-c42f76f3583495579f4c8d415e0b230f">cause or permit any fire to be lit or to place, throw or let fall a lighted match, similar object or any other thing so as to be likely to cause a CommentaryRef="key-877ca34a9bd7c4731d89375d20d38145">In relation to England, the reference to a member of a fire brigade in paragraph (1) is a reference to an employee of a fire and rescue id="regulation-6-2"><Pnumber>2</Pnumber><P2para><Text>Any such person mentioned in paragraph (1) above does not, by reason of any failure to comply with any notice exhibited by order of the Secretary of State, contravene regulation 3(5), (9) or (13)(c) above, and is for the purpose of regulations 2 and 4 above hereby granted permission to do any act mentioned in those <Text>These Regulations apply to and regulate the conduct of persons using all the parks, gardens and other land under the control or management of the Secretary of State for National Heritage which are specified in Schedule 1.</Text>
</P>
<P>
<Text>The Regulations revoke and re-enact, with minor and drafting amendments, the Trafalgar Square Regulations 1952 and the Royal and other Parks and Gardens Regulations 1977. The Regulations also add to the list of areas specified in Schedule 1 the Brompton Cemetery and the Longford River.</Text>
