Movement of live specimens

7.—(1) Where an import permit or any certificate issued in accordance with the Principal Regulation in respect of a live specimen of a species listed in Annex A to the Principal Regulation specifies an address at which the specimen must be kept, any person who, without reasonable excuse, and contrary to Article 9 of the Principal Regulation,

(a)causes or permits that specimen to be transferred from that address without prior written authorisation from the Secretary of State; or

(b)keeps that specimen at premises other than the specified address or location without prior written authorisation from the Secretary of State,

shall be guilty of an offence.

(2) Any person guilty of an offence under paragraph (1) shall be liable—

(a)on summary conviction, to a fine not exceeding level 5 on the standard scale, or to a term of imprisonment not exceeding three months, or to both; or

(b)on conviction on indictment, to imprisonment for a term not exceeding two years or to a fine, or to both.
