The Secretary of State, in exercise of the powers conferred on him by section 20(1) and (10) of the Environmental Protection Act 19901 and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation, commencement and interpretation1

These Regulations may be cited as the Environmental Protection (Applications, Appeals and Registers) (Amendment No. 2) Regulations 1996 and shall come into force on 24th April 1996.

In these Regulations, “the principal Regulations” means the Environmental Protection (Applications, Appeals and Registers) Regulations 19912.

Amendment of the principal Regulations2

In regulation 15 of the principal Regulations (registers), as substituted by the Environmental Protection (Applications, Appeals and Registers) (Amendment) Regulations 19963, after paragraph (c) there shall be inserted the following—

all particulars of any representations made by any person required to be consulted under paragraph 2, 6 or 7 of Schedule 1 to the 1990 Act pursuant to regulation 4(1) above;

The Environmental Protection (Applications, Appeals and Registers) Regulations 1991 (S.I. 1991/507) (“the 1991 Regulations”) prescribe various matters in respect of applications, appeals and registers in connection with integrated pollution control and air pollution control under Part I of the Environmental Protection Act 1990 (“the 1990 Act”).

The 1991 Regulations were amended by the Environmental Protection (Applications, Appeals and Registers) (Amendment) Regulations 1996 (S.I. 1996/667). The amendments included the substitution of a new regulation 15, which prescribes the particulars required to be included in registers maintained by enforcing authorities under section 20 of the 1990 Act.

These Regulations amend the substituted regulation 15 so as to require registers to contain all particulars of any representations made by persons required to be consulted under paragraph 2, 6 or 7 of Schedule 1 to the 1990 Act. Such particulars were prescribed by paragraph (c) of the original regulation 15 of the 1991 Regulations.
