The Lord Chancellor, in exercise of the powers conferred on him by sections 2(1) and 26(1) of the County Courts Act 19841, and by section 33(1) of the Matrimonial and Family Proceedings Act 19842, hereby makes the following Order:-

Citation and commencement1

This Order may be cited as the Civil Courts (Amendment) (No.2) Order 1996 and shall come into force on the following dates:

a

article 4(a) on 1 May 1996;

b

the remaining provisions of the Order on 30th March 1996.

Interpretation2

In this Order, “the 1983 Order” means the Civil Courts Order 19833, and a Schedule referred to by number alone means the Schedule so numbered in that Order.

Amendments to the 1983 Order

In Schedule 1:—

a

“Chippenham” shall be deleted from its position in the second column opposite the entry for “Bath” in the first column;

b

the entry for “Dover” shall be deleted;

c

“Newton Abbot” shall be deleted from its position in the second column opposite the entry for “Torquay” in the first column;

d

“St Austell” shall be deleted from its position in the second column opposite the entry for “Truro” in the first column;

e

“Sittingbourne” shall be deleted from its position in the second column opposite the entry for “Chatham” in the first column.

In Schedule 3:—

a

the entry relating to “Chippenham” shall be deleted4;

b

the entries relating to “Dover”, “Folkestone”, “Newton Abbot”, “St Austell” and “Sittingbourne” shall be deleted;

c

opposite the entry relating to Canterbury in column 1, there shall be inserted the word “Admiralty” in column 2 and the word “Thanet” shall be deleted from column 3.

This Order amends the Civil Courts Order 1983 so as to close the County Courts at Chippenham, Dover, Folkestone, Newton Abbott, St Austell and Sittingbourne. In addition, it is provided that Canterbury County Court shall have Admiralty jurisdiction.
