The Gas Act 1995 (Repeal of Superseded Provisions of the Gas Act 1986) Order 1996

Made

Coming into force

Whereas the Secretary of State is satisfied that paragraph 22 of Schedule 2B to the Gas Act 19861 has been superseded by Regulations2 made under section 18 and 18A of that Act;

Now, therefore, the Secretary of State, in exercise of the powers conferred upon him by section 9(4) of the Gas Act 19953, hereby makes the following Order—

Citation and commencement1

This Order may be cited as the Gas Act 1995 (Repeal of Superseded Provisions of the Gas Act 1986) Order 1996 and shall come into force on 8th January 1997.

Repeal2

Paragraph 22 of Schedule 2B to the Gas Act 1986 shall cease to have effect upon the date of the coming into force of this Order.

This Order repeals paragraph 22 of Schedule 2B to the Gas Act 1986 which provision has been superseded by the Gas Safety (Rights of Entry) Regulations 1996 (S.I.1996/2535) which came into force on 1st November 1996. Regulation 4 of the said Regulations (which contains similar provisions to those of the repealed paragraph 22) enables a public gas transporter through its authorised officers to enter—

a

in respect of escapes or suspected escapes of gas which it conveys, any premises; and

b

in respect of escapes or suspected escapes of gas which is conveyed by another person, premises which are or are reasonably believed to be within its authorised area.
