The Nursery Education and Grant-Maintained Schools Act 1996 (Commencement No. 2) Order 1996

In exercise of the powers conferred on the Secretary of State by section 11(3) of the Nursery Education and Grant-Maintained Schools Act 1996(1), the Secretary of State for Education and Employment makes the following Order:—

Citation and interpretation

1.—(1) This Order may be cited as the Nursery Education and Grant-Maintained Schools Act 1996 (Commencement No. 2) Order 1996.

(2) In this Order “the Act” means the Nursery Education and Grant-Maintained Schools Act 1996.

Commencement of provisions

2.  Section 5 of the Act shall come into force, so far as not in force, on the relevant dates relating to the provisions of Schedule 1 brought into force by this Order.

3.  Paragraph 6(1)(a) of Schedule 1 to the Act shall come into force on 10th December 1996 for the purpose of empowering the making of regulations under that provision and on 1st January 1997 for all other purposes.

4.  Paragraph 6(5) of Schedule 1 to the Act shall come into force on 10th December 1996.

5.  The following paragraphs of Schedule 1 to the Act shall come into force on 1st January 1997:

• 6(2) and (3) insofar as it is not in force,

• 8(2) insofar as it is not in force,

• 16.

6.  Paragraph 14 (insofar as it is not in force) shall come into force on 1st April 1997.

Explanatory Note

(This note is not part of the Order)

This Order brings into force the remaining provisions of the Nursery Education and Grant-Maintained Schools Act 1996 which were not brought into force by the first Commencement Order. The provisions covered by the Order relate to inspection of nursery education funded under the Act. The provisions come into force on 1st January 1997 except for certain regulations making powers which come into force on 10th December 1996 and paragraph 14 of Schedule 1 (annual reports of Chief Inspector) which, to the extent not in force, comes into force on 1st April 1997.

The Nursery Education and Grant-Maintained Schools Act 1996 (Commencement No. 1) Order 1996 brought into force on 1st September 1996 all the provisions of the Nursery Act 1996 with the exception of the provisions brought into force by this Order.
