The Secretary of State, in exercise of the powers conferred by sections 71(16) and 104(4) of, paragraphs 1(3) and 7(1) of Schedule 9 to, the Children Act 1989(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations—
1. These Regulations may be cited as the Child Minding and Day Care (Registration and Inspection Fees) (Amendment) Regulations 1996 and shall come into force on 1st February 1997.
2.—(1) The Child Minding and Day Care (Registration and Inspection Fees) Regulations 1991(2) shall be amended in accordance with the following provisions of this regulation.
(2) In regulation 3 (registration)—
(a)in paragraph (1) for the sum “£10.00” there shall be substituted the sum “£12.50”; and
(b)in paragraph (2)—
(i)in sub-paragraph (a) for the sum “£100.00” there shall be substituted the sum “£110.00”; and
(ii)in sub-paragraph (b) for the sum “£10.00” there shall be substituted the sum “£12.50”.
(3) In regulation 4 (fee on annual inspection)—
(a)in paragraph (a) for the sum “£7.50” there shall be substituted the sum “£10.00”;
(b)in paragraph (b) for the sum “£75.00” there shall be substituted the sum “£85.00”; and
(c)in paragraph (c) for the sum “£7.50” there shall be substituted the sum “£10.00”.

These Regulations amend the Child Minding and Day Care (Registration and Inspection Fees) Regulations 1991. Registration fees for providers of full day care on non-domestic premises are increased from £100 to £110 and for providers of sessional day care and child minders from £10 to £12.50 (regulation 2(2)). Annual inspection fees are increased from £75 to £85 and from £7.50 to £10 respectively (regulation 2(3)).
An assessment of the cost to business complying with these Regulations has been prepared and copies may be obtained from the Department of Health, Social Care Group (SC3C), Wellington House, 135–155 Waterloo Road, London SE1 8UG. A copy has also been placed in the Library of each of the Houses of Parliament.
