This Order may be cited as the Transfer of Functions (Foreign Service Allowance) Order 1996.

This Order shall come into force on 1st April 1996.

Section 319 shall become section 319(1) and—
(a)
the words “by the Treasury” shall be omitted; and
(b)
“(2)
A certificate under subsection (1) shall be given by the Treasury, the Secretary of State, the Lord Chancellor, the Chancellor of the Exchequer, the Minister of Agriculture, Fisheries and Food, the Minister for the Civil Service, the Lord President of the Council, the Lord Privy Seal, the Attorney General or the Lord Advocate.”.
This Order in Council, made under the Ministers of the Crown Act 1975, provides for the Treasury’s function of certifying overseas allowances for Crown servants under section 319 of the Income and Corporation Taxes Act 1988 to be exercisable concurrently with the Ministers listed in article 2(1).
