The Secretary of State, in exercise of the powers conferred on him by section 26(8) of the Education (Scotland) Act 19961 and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation and commencement1

These Regulations may be cited as the Grants for Pre-school Education (Social Security Information) (Scotland) Regulations 1996 and shall come into force on 31st December 1996.

Social Security Information2

The description of information prescribed for the purposes of section 26(8) of the Education (Scotland) Act 1996 (meaning of “social security information”) is any information supplied to the Secretary of State in connection with a claim for, or in connection with the adjudication of a claim for, child benefit pursuant to Part IX of the Social Security Contributions and Benefits Act 19922 and in particular–

a

the name, address and date of birth of the child or of each child in respect of whom child benefit is claimed; and

b

the name and address of the person by whom the claim for child benefit is made.

Part II of the Education (Scotland) Act 1996 provides for the making of grants to providers of education for children under school age. Section 26(2) authorises the Secretary of State to supply to civil servants and others in the Scottish Office, and to those engaged in the exercise of any function relating to the making of these grants, such “social security information” as the person may require for or in connection with the exercise of that function.

These Regulations prescribe information relating to a claim for, or the adjudication of a claim for, child benefit as “social security information” for this purpose.
