The Code of Practice on Environmental Procedures for Flood Defence Operating Authorities (Internal Drainage Boards and Local Authorities) Approval Order 1996

The Minister of Agriculture, Fisheries and Food and the Secretary of State for Wales, (“the Ministers”), in exercise of the powers conferred on them(1) by section 61E(1) and 72(1) of the Land Drainage Act 1991(2) and after consulting in accordance with section 61E(4) of that Act hereby jointly make the following Order:

Title and commencement

1.  This Order may be cited as the Code of Practice on Environmental Procedures for Flood Defence Operating Authorities (Internal Drainage Boards and Local Authorities) Approval Order 1996 and shall come into force on 1st January 1997.

Approval of Code of Practice

2.  The Ministers approve the code of practice issued by them entitled “Code of Practice on Environmental Procedures for Flood Defence Operating Authorities”(3) for the purpose of —

(a)giving practical guidance—

(i)to internal drainage boards with respect to the matters for the purposes of which sections 61A and 61C of the Land Drainage Act 1991 have effect, and

(ii)to local authorities with respect to the matters for the purposes of which sections 61B and 61C of the Land Drainage Act 1991 have effect; and

(b)promoting what appear to the Ministers to be desirable practices by internal drainage boards or, as the case may be, local authorities, with respect to those matters.

Explanatory Note

(This note is not part of the Order)

By this order, the Secretary of State and the Minister of Agriculture, Fisheries and Food approve, in accordance with section 61E of the Land Drainage Act 1991, the “Code of Practice on Environmental Procedures for Flood Defence Operating Authorities” issued by them.

Copies of the code of practice can be obtained, free of charge, quoting reference PB 2906 from MAFF Publications, London SE99 7TP or from the Welsh Office, Cathays Park, CF1 3NQ.
