In exercise of the powers conferred upon the Secretary of State by sections 298(8) and 301(6) of, and paragraph 3 of Schedule 18 to, the Education Act 19931, the Secretary of State for Education and Employment, as respects England, and the Secretary of State for Wales, as respects Wales, hereby make the following Regulations:

Citation, commencement and interpretation1

These Regulations may be cited as the Education (Pupil Referral Units) (Application of Enactments) (Amendment) Regulations 1996 and shall come into force on 1st September 1996.

In these Regulations a reference to the principal Regulations is a reference to the Education (Pupil Referral Units) (Application of Enactments) Regulations 19942.

Amendment of principal Regulations2

In Part 1 of Schedule 1 to the principal Regulations the following paragraph is inserted after paragraph 3—

Education (Schools) Act 1992 (c. 38)3A
Section 9 of the Education (Schools) Act 19923 applies in relation to units as if they were schools mentioned in subsection (3) of that section.

In Part II of Schedule 1 to the principal Regulations for paragraphs 7 and 8 there are substituted the following paragraphs—

Parts I and II of the Education (School Inspection) (Wales) (No. 2) Regulations 19934 apply in relation to a unit with the modification that in regulation 4 for paragraph (a) there is substituted the following paragraph

on or after 1st September 1996 but before 1st August 2001;

Parts I and II of the Education (School Inspection) (No. 2) Regulations 19935 apply in relation to a unit with the modification that in regulation 4 for paragraph (a) there is substituted the following paragraph—

on or after 1st September 1996 but before 1st August 2000;

The Education (Pupil Referral Units) (Application of Enactments) Regulations 1994 ( “the principal Regulations”) amongst other things provide for the enactments listed in Schedule 1 to the Regulations to apply, modified as required by that Schedule, to pupil referral units. These Regulations amend Schedule 1 to the principal Regulations to apply section 9 of the Education (Schools) Act 1992 (inspection of schools), and related subordinate legislation, to pupil referral units with the modifications set out in the Regulations.
