If any person contravenes regulation 3 above he shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding level 5 on the standard scale.

Each food authority shall enforce and execute these Regulations in its area.

In this regulation “food authority” does not include—
a
the council of any district in a non-metropolitan county in England, except where the county functions have been transferred to that council in relation to a structural change; or
b
the appropriate Treasurer referred to in section 5(1)(c) of the Act (which deals with the Inner and Middle Temple).

Where an offence under these Regulations is committed by a Scottish partnership and is proved to have been committed with the consent or connivance of, or to be attributable to any neglect on the part of a partner he, as well as the partnership, shall be guilty of the offence and be liable to be proceeded against and punished accordingly.
