Article 2 of this Order gives the Environment Agency, with effect from 1st May 1996, certain functions in the Isles of Scilly which it has in other parts of England and Wales. The functions specified in Article 2 are those discharged before that date by Her Majesty’s Inspectorate of Pollution. They concern integrated pollution control, radioactive substances and related matters, and include related functions of the Secretary of State.

Article 3 applies in the Isles of Scilly from the same date sections 98 and 99 of that Act. This gives the Minister of Agriculture, Fisheries and Food powers in the Isles of Scilly to make provision by regulations for grants for purposes conducive to conservation, and extends to the Isles of Scilly the Minister’s powers, following consultation, to make and modify subordinate legislation specified in section 99.
