The Returning Officers (Parliamentary Constituencies) (England) Order 1995

Coming into force in accordance with article 1(2)

The Secretary of State, in exercise of the powers conferred upon him by sections 24(1)(c) and (e) and 28(1)(b) of the Representation of the People Act 19831, hereby makes the following Order:

1. (1)

This Order may be cited as the Returning Officers (Parliamentary Constituencies) (England) Order 1995.

(2)

This Order shall come into force on the issue of a proclamation by Her Majesty summoning a new Parliament, except that for the purposes of proceedings preliminary or relating to a parliamentary election held after the issue of that proclamation, this Order shall come into force on 25th August 1995.

References to constituencies in this Order are references to the constituencies in England as constituted by the Parliamentary Constituencies (England) Order 19952 or any subsequent Order in Council in respect of constituencies in any part of England under the Parliamentary Constituencies Act 19863.

The Returning Officers (Parliamentary Constituencies) (England and Wales) Order 19834 and the Returning Officers (Parliamentary Constituencies) (England and Wales) (Amendment) Order 19915 are hereby revoked.

In the case of a borough constituency listed in the left-hand column of Schedule 1 to this Order (being a constituency which is not coterminous with or wholly contained in a district), the returning officer for a parliamentary election shall be the chairman of the council of the district listed in the right-hand column of that Schedule opposite to the name of the constituency.

In the case of a borough constituency listed in the left-hand column of Schedule 2 to this Order (being a constituency which is situated partly in one London borough and partly in another), the returning officer for a parliamentary election shall be the mayor of the London borough listed in the right-hand column of that Schedule opposite to the name of the constituency.

5.

In the case of a county constituency listed in the left-hand column of Schedule 3 to this Order, the duties of the returning officer for a parliamentary election shall be discharged, as acting returning officer, by the registration officer appointed by the council of the district listed in the right-hand column of that Schedule opposite to the name of the constituency.

Articles 3 and 4 of this Order designate the returning officers for the constituencies constituted by the Parliamentary Constituencies (England) Order 1995 in cases where the returning officers are not determined by paragraphs (a), (b) and (d) of section 24(1) of the Representation of the People Act 1983. Article 5 of this Order designates acting returning officers for those constituencies where the acting returning officer is not determined by section 28(1)(a) of that Act (in effect, all county constituencies).

This Order replaces, as respects England, the designations made by the instruments revoked by article 2 of this Order. A separate order has already been made as respects Wales (the Returning Officers (Parliamentary Constituencies) (Wales) Order 1995 (S.I. 1995/1142)).
