The Education (School Curriculum and Assessment Authority) (Transfer of Functions) Order 1994

The Secretary of State for Wales in exercise of the powers conferred on him by Section 252 of the Education Act 19931, hereby makes the following Order:

Citation and Commencement1

This Order may be cited as the Education (School Curriculum and Assessment Authority) (Transfer of Functions) Order 1994 and shall come into force on 1st April 1994.

Interpretation2

In this Order—

“The 1993 Act” means the Education Act 1993;
“ACAC” means Awdurdod Cwricwlwm ac Asesu Cymru or the Curriculum and Assessment Authority for Wales2;
“The Authority” means the School Curriculum and Assessment Authority3;
“Fourth Key Stage” refers to the period set out in paragraph (d) of section 3(3) of the Education Reform Act 19884;

Transfer of Functions3

Subject to paragraph (2) below, there are hereby transferred to ACAC, in relation to Wales, all the Authority’s functions under subsection (1) of Section 245 of the 1993 Act as are exercisable in relation to both England and Wales.

Except in relation to Welsh, paragraph (1) above does not extend to the Authority’s functions relating to the examination and assessment of pupils in the fourth Key Stage or above.

This Order provides for the transfer of certain functions (concerning school examinations and assessment) of the School Curriculum and Assessment Authority (“the Authority”) to Awdurdod Cwricwlwm ac Asesu Cymru or the Curriculum and Assessment Authority for Wales (“ACAC”) in relation to Wales. Those functions are the Authority’s functions currently exercisable in relation to both England and Wales with the exception of its functions relating to the examination and assessment of pupils in the Fourth Key Stage or above in subjects other than Welsh.
