The Social Security Benefits Up-rating Regulations 1994

Coming into force
The Secretary of State for Social Security, in exercise of the powers conferred by sections 57(1)(a)(ii), 113(1)(a), 122(1) and 175(1) to (4) of, and paragraph 2(3) of Schedule 7 to, the Social Security Contributions and Benefits Act 19921 and sections 155(3), 189(1), (3) and (4) and section 191 of the Social Security Administration Act 19922, and of all other powers enabling him in that behalf, by this instrument, which contains only provisions in consequence of an order under section 150 of the Social Security Administration Act, hereby makes the following Regulations:
Citation, commencement and interpretation1

These Regulations may be cited as the Social Security Benefits Up-rating Regulations 1994 and shall come into force on 11th April 1994.

In these Regulations, unless the context otherwise requires—
“the Administration Act” means the Social Security Administration Act 1992;
“the up-rating order” means the Social Security Benefits Up-rating Order 19943.
Exceptions relating to payment of additional benefit under awards made before the commencing date2
Section 155(3) of the Administration Act shall not apply if a question arises as to either—
a
the weekly rate at which the benefit is payable by virtue of the up-rating order; or
b
whether the conditions for the receipt of the benefit at the altered rate are satisfied,
until the question has been determined in accordance with the provisions of the Administration Act.
Persons not ordinarily resident in Great Britain3
Regulation 5 of the Social Security Benefit (Persons Abroad) Regulations 19754 (application of disqualification in respect of up-rating of benefits) shall apply to any additional benefit payable by virtue of the up-rating order.
Amendment of the Social Security (Unemployment, Sickness and Invalidity Benefit) Regulations 19834
Regulation 3 of the Social Security (Unemployment, Sickness and Invalidity Benefit) Regulations 19835 (persons deemed to be incapable of work) shall be further amended by the substitution in paragraph (3) for “£42.00” of “£43.00”.
Amendment of the Social Security (General Benefit) Regulations 19825
Regulation 16 of the Social Security (General Benefit) Regulations 19826 (earnings level for the purpose of unemployability supplement) shall be further amended by the substitution for “£2184.00” of “£2236.00”.
Revocation6
The Social Security Benefits Up-rating Regulations 19937 are hereby revoked.
